Last spring, Marty sent me a bent 3.5" x 8" IH hydraulic cylinder. He knew it was no good because he could not hammer the rod back in for wrapping. I requested a refund through the eBay Buyer Protection plan. He shorted me on the shipping and then banned me from his auctions.

So I opened a new eBay account and email address. I bought a 560 Fast Hitch bail (Marty calls them hoops) and five other items in early NOV. The bail never showed up. Again, he refunded the bail price ($9.99) and less than half of the $30 shipping cost. He banned my new account.

A week ago, I won a 504 Fast Hitch bail (by itself) with a new account and email. He peremptorily declined to ship and returned the bid and all the shipping.

He has another 560 bail closing in a few days. If I get a new account and email, eBay says they will punish me if I bid on Marty's stuff.. My only recourse now is to get a proxy bidder. I have not done anything wrong and there are no winners here. Marty doesn't get my bids and I don't get the parts I need.

The following are the emails between Marty and myself. You should start at the bottom and read up so they stay chronological. My handle is "retiredparts".



Your problem is that you can't think clearly. I have closed no accounts. You have banned me from your auctions only because I submitted negative feedback which was deserved. I opened new accounts to get the parts that I need. You failed to honor your part of the eBay contract by not shipping after I paid for the item. I still haven't seen that tracking number for the "Hoop" you said you shipped the first week of November. You are a liar.

And a cheat. You tossed the "Hoop" into the dumpster where it will fetch about $5.00 at the scrap yard. You shorted me about $5.00 on the shipping which is an eBay violation, Now you have met the sale price of $9.99 and you didn't have to source cardboard and spend the labor to wrap and label it. If it had bid to $20, you would have shipped it. Let your account rep read that.

I have purchased at least 75 items from you over the years. You never left feedback so I didn't bother. You should be thankful because you would have always gotten failing marks on communication and item description. It became clear to me that you would retaliate if served with a negative feedback. When you sent me a bent hydraulic cylinder, that you knew was bent because it would not close for packaging, I had enough. This happened last spring. I was banned after leaving negative feedback and I opened up a new account. You have to be "nutz" to ban a paying customer. That is the essence of business. Getting and keeping customers. "Stupid" will do and it fits you nicely. BTW, I retired at age 53.

When you get a chance, goto Yesterdays Tractors website and search all the forums for your name. You are not held in high regard.

If you were any kind of A good business man you would not have to close accounts and re open them. That sir is who is dishonest here not me. And you are right we do sell A lot of parts you could use. But unfortunately for you I won't sell to you. And please send your negative. I am here to stay unlike you and your multiple accounts, I sell with the same account and do good business with it. I think that you are the type who wants all things your way no matter what the cost to others, and as far as making 5 bucks on A part as you say, What would the 5 bucks do for me, I would rather have the parts get shipped to their rightful owner and move on to the next part. You also state of all of the problems you have had with me, Why am I just finding out about them now???? You are the sneaky underhanded one here not me. Marty

Slick???. You returned my money and banned me. You failed to ship just like you did with this auction. You don't think that is worth a negative?

I paid immediately and in full. Your obligation was to ship and you have now failed twice on two "hoops". And on several occasions in the past, you have partially stiffed me on the shipping part of a refund. Over the years, I have let many of your short comings slide. Busted distributor caps, broken off bolt butts (that you broke) which I had to extract, small parts from "leaky" packages that were missing, and title description and nomenclature totally inappropriate. When you sent me a bent hydraulic cylinder (not visible in your photo) last spring that could not be retracted, I had enough. I gave you a well deserved negative and you blacklisted me. I trade with you because you have alot of parts for the '54 thru '65 IH tractors that I own. More than anyone else.

Now why is it you won't send the "hoops". UPS lost it??? Yeah right. You made about $5.00 on that first one by NOT shipping it. Why don't you show your account rep the tracking number? I'd like to see it too.

You are going to get another negative. All you had to do was ship this auction. You had the money for Godsakes. Banning me won't allow me to put money in your pocket. It's your loss.

You sir are pretty slick, you start A new Ebay account after doing what you did with the feedback on Ebay. What are you going to try and do this time?? I have banned you and will not ship parts to you after the last episode we had. I also talked to my account rep about this mess and they are working on it as well. If I am as bad of A seller as you described me to be why go through all of the trouble to start over?? You People never cease to amaze me. Have A nice Day. Marty
