Dropped Cub Cadet

Two years ago last month (Apr '97) I purchased a new Cub Cadet 2165 w/46" mower deck. When I arrived home from work on the day they were supposed to have delivered it, I had a message on my asnwering machine from the delivery man, applogizing for "dropping the tractor off the back of the truck onto the roadway." Naturally, I kept the recording. I called Feldman's Lawn & Tractor where I purchased it, and they said they would order another one. They delivered the "new" one, and it has been leaking hydraulic fluid ever since I got it. They told me I had too much hydr. fluid in it; that I had the wrong lenght dip-stick, etc.
They have since gone out of business. Is there any way of determining if this is the "dropped" tractor?
