I understand where you guys are coming from but I also agree that it was a tragic accident. I know it is easy to blame the parrents. From what I read the 9 year old driver was going slow in first gear. He had come to a stop. I would GUESS the 2 year old was riding in front of the driver and the 5 year old behind him. It is only natural for a 2 year old to grab anything to hold on to and in this case sadly it was the throttle. Hind sight is 20/20. If it was out of gear this or the engine was turned off this wouldn't have happened. But they weren't and it did. A saftey switch on the seat would not of prevented this from happening becouse the 9 and maybe 5 year old would still be seated. If an adult had been driving it still most likely would have happened.
When I was 9 years old I was Driving a B John Deere pulling a 5 disk oneway or a tumble type stalk cutter and tandom disk 2 miles from the house at the second place we farmed. When I was 10 I got a single shot .22 for Christmas and could go hunt with my friends without asking. It was not only me, but most all of my classmates that grew up in the country did this. Noone thought anything about it and none of us were hurt or killed. When did things change? How old does a child have to be now to stay home for 1-2 hours after school until there parents get in from work? I don't think anyone can put an age on it except lawyers if something goes wrong in that 1-2 hours.
I an 62 years old and have an ATV that I or my sons or daughters-in-law take my 2,4,6 and 11 year old riding on, also at slow speed but only one at a time. I will now make sure the engine is off before they get on or off.
I would bet the 9 year old driver of this ATV was good driving it. Otherwise he sure wouldn't have been allowed to ride the others on it. If he had been hot roding or doing wheelies, then hang him, but he wasn't. This is very sad and my prayers go out to all of them, but not blame. It was an accident.
