I asked the same question at the bulk plant where I get my farm fuel. I get the off-road diesel with no taxes added, but if I buy gas it is taxed just like at the gas stations. They said that it is the law that all gas has to be taxed. They did give me a form that I could fill out at the end of each year and send to the KY Revenue Cabinet. I could get the state portion of the tax back, which I think is only 7 cents a gallon in KY. They said you can't get the Federal portion back. 7 cents a gallon just wasn't enough for me to fool with. The tax may be higher in your state, so if you use a lot of off-road gas it might pay for you to check with your state's revenue cabinet. I guess there's just not enough off-road gas sold to justify coloring and selling it separately like they do diesel and they are afraid people will use it in road vehicles if they don't. In KY they check diesel trucks for off-road fuel every once in a while. If you're caught, it's $500 dollars a gallon.
