They put the same thing in effect here this past Jan 1.
I'm in Chambers county about 50 miles east of Houston.

In our E Tex zone agriculture tractors under 40hp are exempt so far. The 40hp exemption does not effect tractors that are used for construction, lawn or turf work, they still can not be used.

The farm has 10 semi for local delivery trucks. Out of the 10 trucks 4 failed the tail pipe sniff test and had to be taken to Detroit Diesel to be tweaked and tuned.

Our county does not have the tail pipe sniffer yet but we operate the trucks daily in Harris, Ft Bend county, and Houston so they had to be inspected.

Also the trucks can not be idled over 15 minutes while parked. Our trucks have to idle because some of the trailers have hydraulic pallet slides (walking floors) that are powered by the truck engine.

The Harris county inspector told us that if the truck or any other vehicle failed the test after you have spent $1500 in repairs and been inspected 3 times they will exempt the vehicle. We have Teledyne forklifts we could use but they are all considered construction equipment, plus they all smoke like a tire fire.

It looks like the $1500 per vehicle is what they are after and not the pollution.
