As far as I know the emission regs don't apply to stuff under 80 hp but I could be wrong.
I can tell you this... if I have a choice between an engine with DEF and an engine with EGR... I'll take the one with DEF every single time without a second thought. EGR is a nightmare that doesn't work and never will work on a diesel engine (reliably). With DEF you essentially have a Tier II engine with aftertreatment and Tier II engines were about as good as diesel's got in most respects.
