I think LJD covered it pretty well but a few more things should be added. The biggest thing I can think of is your state may have some specific laws that protect cemeteries/burial lands. We have that here is WI and those lands are protected, much more now than they were even a few decades ago. Like LJD stated, sometimes the remains are moved to a different location but untill then, its protected land.
Check the land ownership, like stated, SOMEBODY owns that land. Here in WI, cemeteries dont pay taxes but they are still listed on the tax rolls just like other tax free lands like parks and schools. Just check your local tax rolls to find out who the official owner is.
Here, even if a small family plot is abandoned in the back corner of a farm, that plot ownership defaults to the township or county to take it over. Usually cemeteries have a board that votes on things and takes care of maintence but if that folds, the county takes care of it from then on. Depending on the county, it may be just closed or you may be able to talk them into letting you bury somebody in it. No matter how you slice it though, its still owned by somebody (even if its the county) and you can still find out who that is by searching the public records. If it is in fact still a cemetery, there may be state laws protecting it and if its been forgotten over the years the state may just need a reminder.
You can also do a little research to see if there were any veterians buried in it, if there were, I dont think the local VFW would take to kindly to it getting plowed under so somebody can get a couple more bushels of corn out of the field.
