This happened to our home farm. Dad had sold 146 acres on payments to a local fellow. dad was old, & suffering from the early stages of altmers and IMO too trusting. He had not considered Logging.
The fellow had started logging the place, and it was right about the time I had obtained power of attorney over dads affairs. I told him that he should not strip that land, unless it was paid for. He felt that he did not have to listen to me, since he did not make the deal with me.
I took him to court, and lost, since the issue had not been originally addressed in the contract.he was always on time with payments, i could not throw the bum out. So I sold the entire mortgage to a finance company, and I told them the situation. The finance man just grinned, and said they would put a stop to it.
I guess they did, because the guy called me boiling mad, I told Him it was out of our hands, and he needed to deal with them.
So the guy defaulted, but not before stripping that farm Scrapping dads nice double wide, and every piece of metal he could find. The tenant house burned to the ground, and nothing is standing except one outbuilding and the tobacco barn.
I'd like to see that fellow again......I went down there after 20 years..last year...and I'm not the sort of guy that cries, but i wept like a baby that day, To think of what Mom and dad had worked and built up over 50 years, now lies in total ruins. And it was such a pretty old farm too!
But...... at least I still have dads old farmall.
