Your transmission is overfull. Either thru overfilling or thru condensation and/or leakage down the gearshift lever. When the transmission is at the proper level it is below the seal. That seal doesn't act as a dam but to keep splashing gear oil from leaking.
The proper amount of gear oil is only 3 1/2 PINTS. Drain it and refill with about 3 pints of kerosene or diesel. Drive it around about 10 minutes and drain. Refill with 3 1/2 pints of your favorite gear oil.
