Trouble with starter on 400D

I've got this weird problem and need some advice. When I engage the starter I get this whinning noise then it engages in the ring gear and starts. I've got a rebuilt starter in it, the ring gear is reasonably good, and I have lots of amps. My theory is this, the starter contacts are conecting (in the solenoid) before the pinion gear is engaged in the ring gear. How can I correct this? Or, is my theory FOS? Anybody have ideas on this before I ruin the starter and ring gear?
