Not providing wear parts with grease when they need it may delay having to buy more lubricant, but you could end up spending much more time and money replacing parts. A similar comparison can apply to spending some money for legal help [grease] when it is needed, as to spending a real bunch to clean up a big mess later. Please do not think that I am in bed with the BAR Association and trying to generate more business for the lawyers. On the contrary, if you wait until you’re in a mess, you could well spend more time and money on lawyers than if you spent a little money earlier. Here is a link to a lengthy Iowa S.C. ruling that is an example of waiting too long to get advice or not acting after obtaining it.

The way my Dad stated it is: "You pay for a lawyer, whether you have one or not".

i had a mess when tall kids mom passed away.
she had not changed her will after we were married and didn't get changed after tall kid was born either. she passed away of a sudden illness leaving all of her stuff to her sister. well she thought she would hold that over my head and do dam well as she wanted until i saw a lawyer. he said in il as spouse and child you are entitled to a certain percent of her estate in which she was wed and give birth after the will was made and not updated. i saw another lawyer and he told me the same thing. her sister learned the same thing from her lawyer. she was fit to be tied. my lawyer learned from her lawyer sister about went thru the roof as she was mad when she found out she didn't get her way.

John T. Thanks for your ideas. For years I suggested, pushed, begged and pleaded with my parents to see a lawyer and resolve estate issues. Everyone accused me of being mean. I saw both mom and dads families turn on each other after the death of my grandparents. When I finally got them to the lawyer my parents could not explain what sources of income they had or what their assets were. They didn't know what they wanted except to put it into a "trust". I knew then I would never see the lawyer with my parents unless 2 of my siblings were with me. Shortly after that my siblings (not bright people I may ad) closed in aroud my parents and I was excluded. Fair enough, my parents should take consul from anyone they want. As a guy with 20 years of law enforcement and 5 years as a building contractor I told them I have found the following truth to be self evident "In any negociation the person that cares the least will win". Wrap it up tight, make it so that everyone is mad at the dead person. It wasn't to be, the situation is now FUBAR, as we used to call it in the Army. However the farmland is mine, I just wasn't going to let it get mortaged to pay for cars, trucks, trips, clothes or whatever only to have it actuioned off in bankruptcy court. Not everyone from California is gready or has bad intentions. I fly back and see my parents 4 to 5 times a year.

Hi Scott, I believe ya, since I live in Indiana I just used California as an example, Im sure yall got my general meaning, its the mean kid farrrrr rrrrr away who often comes in n does as I stated.....

I do a fair amount of estate work n its so sad to see how families break up n feud when mom or dad dies

Being semi retired I dont want very much legal business so sure NOT looking for more lol. Last time the yellow pages called wanting me to advertise they went on how Id get more calls n business etc to which I responded THATS THE LAST THING I WANT IS A BUNCH OF PEOPLE CALLIN N BUGGIN ME AND MORE WORK FOR ME TO DO LOL. They gave up n hung up

However I must say Ive found what you say to be true in many situations. For example, I have clients come to me concerned about things such as a Power of Attorney or Healthcare Representative Appointments or Wills or Living Wills etc for their aging parents. I tell them heres the deal. IFFFFF FF their parent is fully functioning and mentally competent AND MOST OF ALL wants and is willing to execute such documents and assign certain powers NOW the cost is very reasonable and can save heartaches and hard feelings later down the road. HOWEVER if they wait till they are incompetent they then lack the capacity to do the same which means very expensive Guardianship proceedeings n doctors n lawyers n expensive expert witnesses and family fights etc. etc. I do some probate work n it seems it NEVER FAILS, Mary lives next door to mom n works like a slave carin for her for years then mom dies GUESS WHAT big shot brother from California who never came to see mom or help now wants to run the show n dicate to the family what to do grrrrr rrr. When people need medical advice they go to the Dr. n if he says an organ is bad they take his advice n say rip it out or if the car is bad they do like the mechanic said or same for plumbing n other skilled professional help n never question it but let a legal question arise (where the lawyer might save them thousands) then they take the advice of their brotehr in law lol n wonder why they get sued later n have to run up one enormous legal fee to get em out of a mess which good advice up front may have saved them from.

Oh well enough soap box for now, Im sooooo o glad I retired as an electrical enginner n had a real life in that n farming long before I became Law Man cuz Id hate to have to scrap n fight n dig n cut throats n engage in allll that nasty hard dirty fighting to make a living whewwwww

Didn't read the whole thing, but I skimmed through it. Sounds like a pretty sad story of family turning on each other.

To add to NEsota's wisdom, here's some I heard recently:

"A good lawyer and a good accoutant are free."

And from what I've seen in my personal and professional life, it's very true. If you've got any sort of business going on, or even if you're just faced with the possibility of family arguemnts over money, a good lawyer and/or a good accountant are worth every penny.

Yep--had that problem in my family, when Mother died, the last old person. My sister had moved to Florida 25 years before and never came back to visit, or for anything. Brother moved to Texas-same thing-never came back, except once to grab what he could! Well, they died happy, surrounded by everything they wanted, except good health! What did i get? A bunch of bills and expenses, some old pictures, and thats about it. Ohh, i got the good health, mostly! Must of been that hot weather that did them in, or else it was "The Crabbies"! They forced me to sell Mother's house, in the bottom of a poor real estate market, then complained i had sold it cheap! I didn't bother with an answer!
