this site has a disturbing article from an ashand ky newspaper about a teen getting shot over hay. with so much talk lately about hay theft, is this what its come to? i am saddened. Link

i have a freind who lives in ashland. the following is what he told me as a third party story so take it as you will. apparently the theiving had been going on some time. the police had done nothing and the farmer said he would. there were also guns found in the theives truck. the truck was rigged with a spear and winch to move hay. the farmer was also really short of hay this year. im sure the police had better things to do. most law enforecement officials work as hard as they can with the recorces they have, unfortunatly things like this happen all the time. in this case both parties will suffer for a long time. i also think there is more to the whole story and plan on following it. im sorry for the families involved.

here in ky many farmers carry guns due to thieves and rogues i see nothing wrong with killing a theif what good are they to the world we have been robbed twice and will have no problem shooting a rogue

In Seattle during the gas shortage and long lines a guy had his gas stolen from his pickup. The next week he saw someone stealing gas again and stepped out on the porch and fired a "warning" shot. It hit a kid that was siphoning gas into a 5 gal can square in his back. He died over a 5 gal can of gas and the shooter got off since his intent was not to harm but to warn. Rock salt is best in simple theft cases although the lawsuit will still be pretty big. The thieves have the law behind them.

My neighbor lost some hay this year out of his heifer barn. He is a big time operator and owns more than one farm, and unfortunatly he can't be everywheres to once, and some low lifes started stealing pickup loads of small square bales out of his heifer barn located a mile from his main farm. Through telling his neighbors about it, and setting up a neighbor hood watch of his heifer barn, we got that stopped, the thieves were never prosecuted, but they did get ran off. I think its a good thing the owner didn't catch them, because he was pretty upset about it, and problably would have beat them up if he had caught them in the act. Its not that hay was scarce or anything because it was a bumper crop year, just the thieves didn't want to buy it and the hay was actually for sale that they were stealing.

I hate to think of the stealing thats quite apt to start happening with the high cost of fuel oil here in the north east. Lots of people are getting squeezed quite hard and home heating fuel is a nessesity. The other day when I was in a grocery store, I saw some guy in his late 20's slip a magazine off the rack into his jacket, then walk over and join his woman and kid, what a bum, like a magazine is a nessesity.

It is a shame that someone died, but that is the risk he took by trespassing and stealing. Recently three people broke into my bosses house, took guns and credit cards, used the cards and there is a record of who, where and when. After two months no one has been charged. If it happens again, I would bet someone gets shot.

Common sense, knowledge on the law and helping your law enforcement people do their job after discussing what you can do to help with them seems to be a better plan, why risk your rights and privilges to own firearms and become a criminal while trying to mitigate theft,or other crime, personally I hate a thief no matter how small, somehow you can outsmart them, here is an excerpt of NYS law, I think it's highly imperative to have a working knowledge of laws that effect you or situations you might be involved in, before they occur.

himself or a third person, or in defense of premises, or in order to prevent larceny of or criminal mischief to property, or inorder to

Penal Law, sec. 35.30, titled "Justification; use of physical force in making an arrest or in preventing an escape", provides: NY Penal Law section 35.30(4) states: "4. A private person acting on his own account may use physical force, other than deadly physical force, upon another

such purpose when he reasonably believes such to be necessary to:(a) Defend himself or a third person from what he reasonably
believes to be the use or imminent use of deadly physical force."

Using a gun to stop a hay theif? T. bone is right, something else is going on. The shooter must have had a loaded gun at his side when the bale was stolen. Either there were problems in the past or the shooter is paranoid. Jim

I have a subdivision along one side of a field I hay and if I leave bales on it overnight the ones along that side will disappear. You can see the pattern of missing bales from the front of the field. Amazing how the yield can be so light in those couple of rows on that side! Why do they steal something they have no use for? About 25 bales a cutting. Worse yet, now they are mowing their lawns deeper into the field each summer AND stealing bales. Don't want a fight but this is getting expensive. Don't figure on shooting them though.

We don't hang hay thieves around here!!! I think if I could get them in front of a judge I could persuade him to have them do a couple of days haying with me. Might give them more respect for what it means to skim the cream of my milk!
Heck, if they would come out and ask me I would give them some bales for a little help loading.

Two of my nephews were shot one while hunting he unloaded his gun on the shooter and he came back and paid for all the hospital bills, the other was a lot dumber he was trying to steal some Pot and the guy raising it shot him in the chest the kid almost died but he did give up drugs after that.

I might have fired a warning shot in such a case, for the deterrent effect. It would probably have been sufficient to leave the dead guy in question alive, and keep him and anybody he hung around with from coming around again.

I would not have fired the second shot. It was a bale of hay, and he was leaving. I could only fire directly at someone who chose to come at me after the warning shot. That's my conscience and, I expect in many places, the law, guiding that statement.

Even given the remote possibility of a ricochet, I'd put a warning shot into the ground. Had a fellow working for me a few years ago, who supposedly (I don't buy it, but the jury did) fired a warning shot into the air when he heard someone breaking into a neighbors machine shop, maybe 25 yards up the road. The warning shot (he said in court that he fired straight up or nearly so, and that it was the only shot he fired) somwehow made its way through the back window of the offender's car and severed the neck of his girlfriend who was in the back seat.

Think about it. Years ago if you stole a horse you would be hung. Now days people steal any most any thing that isn't bolted down or chained down. Yep its getting bad and probably will get worse

I have a feeling there's more too the story that's being told a this time. He had already accomplished what he set out to do, scare the bee jesus out of the boys so they would think twice about committing there next theft. Did we get lucky his missed!

To fire a warning shot then fire another shot to kill for simple theft just doesn't sound right. If his intent was to kill the theif then he'd never have fired a warning shot.

Think I'll wait for the rest of the story to surface.

Our laws are partical at fault for the simple theft in the first place. When I was in Denver 30yrs ago and had someone break out my wing window and steal my CB, the cops said they were too under staffed to be concerned about petty theft.

When I called last year on kids tearing up my neighbors car he has stored on his property, I once again heard were too under staffed to be concerned about simple theft.

So then if no one trying to stop the theifs it just has to grow larger to my way of thinking until someone says no more.

Ken is right .. You cannot shoot a fleeing felon., and stealing a bale of hay would barely qualify as a crime, much less a felony.. I know stealing is wrong, but the bad part is, the shooter's life is ruined now.. The only way that I will shoot, is if the crook is coming at me, with intent to harm or kill me..

I am not say'n kill'n is right, I am not say'n the boy needed kill'n, but in Kentucky this year there is no such thing "just" a bale of hay. I bet there is more to the story, but around here I would more at ease mess'n round with the farmer's wife than I would swipe'n hay. There is none to be had.

Its too bad that he fired the first shot as a warning. This caused him to get charged. He should have made the first shot count, while the thief was on his property. If I was on that jury, I could guarantee a deadlock, or not-guilty. The thief got what hes deserved. Its time for people to stand up for their property. Tom

Well I read that story and was saddened to hear someone killed over a bale of hay. But where does that teen get off thinking he can take what does not belong to him.... what is this world coming to. Trespassing and theft are crimes that warrant punishment and in this case because of a choice that teen made today he suffered the ultimate punishment.

Sounds like the theif paid the ultimate price for his crime. Too bad the police didn"t catch him, he would would have been given free shelter, free food, free health care, free legal aid, etc. That is what is wrong with the country, theives are not afraid of getting caught! Unless it is by an over zealous land owner.
