land lease ?

My neighbor wants to pasture his horses on a couple acres my our land. I told him it was okay as long as he sighned a paper that I was not liable if anyone was hurt on the land. How should I word this when I type the paper up.

Just remember the old saying that good fences make good neighbors. You can find sample land lease documents online or get a CD of legal forms for a few bucks at the Mart. Personally I would make the lease very short term, so you can deside if you want to renew it or not.

Hard to keep a good fence with a bunch of horses always pawing at it or scratching and reaching over it. Unless times get really bad and I have to have a horse to plow with in order not to starve, there will never be another one on my place. Especially someone elses!

A while back I prepard a Farm n Crop lease for a client and included the general boiler plate legal schmegal making the Lessee responsible for damages or injury on or about the premises occasioned by the use of the land and/or livestock on or off the premises..... ....

and that the Lessee shall indemnify, protect and hold harmless Lessors from and against any and all claims and all loss or damage to persons or property or death or injury arising from Lessees’ own acts including farming or pasture use, including the acts of its agents, contractors or employees on or about the Leased Premises, and from and against all costs, attorney’s fees, expenses and liabilities incurred in the defense of any such claim or action.

On a pasture lease ITS VERY IMPORTANT to define who is responsible for fence maintenance cuz if the land owner is yet livestock escapes n causes injury GUESS WHO MAY BE LIABLE????? ????? If I represented the land owner Lessor, Id want the Lessee to be responsible for fence maintenance if that could be negotiated !!!!! !!!

Then I had a clause requiring the Lessee to provide Liability Insurance

Then more blah blah blah and yadda yadda yadda etc etc etc lol

MY BEST FREE ADVICE IS TO CONSULT A LOCAL ATTORNEY cuz a couple hundred bucks well spent may save you thousands down the roads in case a horse got out and caused an auto accident n killed a child.

There exists "common law" to sort out liability and contractual issues in the absence of a writing in the event you verbally leased pasture and a horse escaped n caused injury, but my advice is to use private contract law (i.e. the lease) to define n settle all the issues up front. If a potential lessee isnt willign to sign a lease and be responsible for his horses, Id tell him to hit the road.

61 I don't feel anyone "answered your " question. Talk to a lawyer in your state. Liability is an issue if you receive money for this. Abandond horses could be an issue. Watch out for any conveyed property rights if they use it long term. If they fail to care for the animals the humane agents could go after you. Hope this gives you better ideas. One suggestion would be a contract, have an ending date and get a security deposit to cover any of the above. If they agree to that you probably have good tenants.

Ask your insurance how to word the document so that you can"t be sued. Buy your own gates. That if things go wrong you can take gate, get in writing about the fence on your property. Some people treat horses like thier kids, other use baseball bats to break horses. So which type of people do you want to deal with. Old country saying "If you want to know how a man will treat your daughter, see how he treats his dog.

They are going to fence it in and are letting me use running water and electricity both of which i dont have on the farm.

my neighbor le roy had the same problem a woman brought 2 horses out for le roy to "board" well she paid him for the first few months and then quit paying him and seemingly forgot where she left the horses. she also parked her horse trailer out there. she finally gave le roy the horses and title to horse trailer.

All I can tell you is DON'T do it. Lots of old horses or young either have and are being left on people's places. With hay prices getting and no killer market it will only get worse. I know don't sound very neighborly, but I have had this happen to me 3 or 4 times. A couple of neighbors just wanted a place for them to graze part time. One moved and the horses were here for 5 years. A couple more offered to pay me 25 dollars a month and buy there hay from me. Guess what? I got 25 dollars a piece and the horses. I traded them for a couple of shotguns. Just know your neighbor good, and be prepared to adopt some horses
