Up until a couple days ago, my wife drove a 2001 Honda CR-V, nice little car for her. Anyway, someone made a left in front of her. The front is heavily dammaged, both airbags went and the roof buckled. She is doing O.K., has a lot of bruises from seatbelt, airbag. She has a stiff neck. I have to call the totalling adjuster, but I don't want to get screwed, we just want to be back where we were before. Kelly Blue Book shows it worth $11,005-$11,755. Any advice?

Yep, get a lawyer. Back in 2001, 3 days after 9/11, someone turned left in front me while I was doing 65 mph on an undivided highway. I didn't go to the hospital cause I thought it was just going to be bad bruises. A few months later, I started having back aches and neck pain and it continued until I had a blowout on a cervical disc about a year and half ago. Doctor said that the injuries to that disc showed signs of trauma. I never had back problems before. Makes me think that accident may have had something to do with it. Effects of a bad accident are long lasting. -stephen

last Oct I wrecked a bike not my fault. One week later the back felt better than it had for a lot of years. Started in at the chiropractor first of Nov for a check up and got worse. 4th of Jan back let go and couldn't hardly function was scheduled for a Mri on the 5th due to slow going down hill. Report showed 5 bulging disks caused by the accident. Was told they didn't show up earlier due to being soft tissue damage that won't show on an xray. The body tenses up and has to totally relax for the damage to show, in my case took approx 3 months. Refused to talk about cutting on me. Found a place that did spinal decompression 22 treatments and two months later back at work on limited duty. Now back up to speed still going to the chiroprator that has always taken care of me, HE DOES NOT WANT ME THERE ALL THE TIME,good doctor.
Point I am trying to make is get a lawyer and be prepared for the long haul. I settled for less than the bike's book value but more than made it up on pain and suffering.

PS I did not use a lawyer as I was going against my own insurance due to other driver having no insurance. Agreement with my agent is treat me right and no lawyers. let adjuster try to work me over and She handles it or a lawyer will. So far every time she handles it and I get what I want

My wife got hit in our pride and joy Buick Roadmaster last winter. Your wife needs a lawer and get her to a doctor today! She needs to be at least X-rayed and the lawer will have her at a cyropractor to straighten her out. My wife did not seem hurt but as the days went on her back hurt at night and she got headachs everday for months. The cyropractor fixed it but I have no idea what the final outcome with the lawer will be. Get you wife straight first and you will find a car in time. Let the lawer do the rest.

That is their game and they are good at it. They try to get you to engage your argument in a petty $ number to cover the bigger issue. Don't take the bait! why settle for a small number when there may be much larger problems. They will finally give you the extra thou but that is their game, to JUST pay for the car. The tactic is the typical lowball issue. Argue for pocket change so as to loose sight of bigger bucks. DON'T ENGAGE in the petty change. Like others said get a snake of a lawyer and go for the GOLD! Everybody hates the lawyer snakes till they need one RIGHT!

prepare for a battle and about a year It is like an auction. Mom totaled hers the company totaled it and gave more than we thought and provided a rental for 1 month no hassles it was over fast. couldn't figure that out?????

just spoke with adjuster, they want to offer us private party price for it, more than $1,000 less than retail. I'm calling my company right now to get advice, but I'm sure not settling for that. My wife's neck seemed to hurt more after she heard that. BTW, the other driver was cited.

Get a GOOD lawyer NOW. Even if it IS her fault and most certainly if it isn't. Don't AGREE to, DISAGREE to, or TALK to anyone at either insurance company, (YOUR'S or THE OTHER guy's) until you have a LAWYER. They (the lawyers) will take accident cases on contingency basis, which means they don't get paid unless you win. The insurance companies you can rest assured will have THEIR lawyers looking over everything - so should you!
BTDT many, many times with my husbands mileage rate that he does every month, Don't ask....

Find like/ nearly identical cars in your area. Get the price in writing or print out ads, show it to the adjuster and then stick to your guns. Look on traderonline.com for like cars. Or several local dealers. Also get a rental car out of them if your coverage or better yet the Other guys coverage takes care of it. If the insurance company has rental money going out every day you will be on their mind! Remember though the rental coverage stops as soon as you accept their offer not when you get your new car. Some may stop paying once they make an offer. check on that. That is what you are insured for, replacing your wrecked car and having a car to drive until you can repace it. Not to sell your car to them which is what KBB are for. Also call a wrecking yard and see what your wreck is worth. The insurance company should allow you that price if they keep the car. You are within your rights to keep the wreck and sell it yourself if they won't allow you what it is worth. Remember it is YOUR car. Not the insurance companys. And do not be afraid to ask for and contact anyones suprevisor if you do not like the settelment you are offered. Be polite but know what your cars replacement will cost you to drive it away and the get that amount. Good luck.
