I was trying to figure out the best way to find out if tractors and or equipment that a person is thinking about buying is clear or has lein against it. Anyone have any ideas on that? A person could be in for a rude awakening if they baught something that really belonged to a bank or some finance company and not a personal owner. You could be out your money and your purchase cause it would be the same as receiving stolen goods. I've not had any problems like that before but I got to thinking about it as I'm looking at buying a tractor in the $9,000 range and the thought of being out of the money and the tractor makes me nervous.

I lived in Sudan 15mi.east of Muleshoe,Tex. back in the late 40's--early 50's, we called Muleshoe --Jennyslipper.

The method of perfecting a security interest varies by state- some are at the county level, some at state level. In Washington, for instance, security interests are filed with the Secretary of State, and can be checked online, if you know how. Best way to find out how it works in your state is to contact a lender that makes loans on farm machinery (Farm Credit, Farm Services Agency, or a machinery dealer) and ask.

Go to the courthouse of the county the seller lives in. I had to do this quite often when in business yrs ago. Then go to County Clerk's office...they will ask the name you want to look up, they will hand you the book...it's a biggie. They have to show you the book as liens are open for public scrutiny. Some people will amaze you...their equipment has liens on everything they "own" and even sometimes owe more on a machine than it's worth!

It is said to say but in this day and age a mans word is not worth much anymore. Even someone you have known all your life can turn out to be a crook or a lier. I have seen many people take advantage of their friends when it comes to money. Greed is and always has been the down fall of man. Some people can only see $$$$$ in front of their eyes. Believe it or not God has the final say, we will all face Him one day. Gary

Believe it or not, I've been to Muleshoe. I used to be stationed at cannon AFB, just over the border in New Mexico...my buddy's wife is from Muleshoe, very small town, lots of ranches.

Gary, the name of your town has got to be one of the best darned names I've ever heard of. There must be a story behind the name Muleshoe. I had several Army buddies from Texas yrs ago...they were full of more crap than a Chrismas goose! (I mean that in a positive way.) Us midwesterners don't use such nice and colorful language so it's fun to talk with those army buddies now and then. My best buddy is buried in Lockhart. I miss him still.

In Georgia a lein or mortgage is usually recorded at the courthouse as a matter of public record to be considered legal for enforcement.

One suggestion is to copy the model/serial numbers, give them to your local friendly law enforcement types and let them run them through NCIS. You can't find out if there is money owed or not but you can find out if it's stolen

If I was buying an expensive item, say a tractor for $10K I would want to see the last payment made statement from the finance company or something. Several years ago a guy I know asked me if I wanted to buy a 4 year old tractor for $5,000 it was worth over $10,000, JD 30 HP, front bucket, diesel. I said Naaaaa.....not interested. Got to be careful out there hot items are all over, get proof of ownership.

We have a local concrete construction man who bought a nice backhoe from a local man paying for it when he picked it up. Turns out the bank still owned the backhoe and he had to buy it again. The only satisfaction he got was calling the cops when he saw the former owner hiding and seeing him hauled off in cuffs.
