Do I need a Title for an 8n?

I'm new to old iron. I'm interested in an 8n, so I answered an add in the local paper. I met the guy (who admits he knows very little about tractors too), made the deal, shook hands, and then he said, "the only problem is I don't have the title for her." My gut reaction was - you don't need a title for a tractor, but a little red flag started waving in the back of my head. I said I'd do some research to find out if this is a problem and get back with him. I left without the tractor, but now it's 2am and I can't sleep. Any wisdom would be greatly appreciated.

You didn"t say where you live, but in North Carolina you don"t have to have a title. Keep it kinda quiet tho. If the powers that be hear that another state has to have one, we will too.

Aloha, The only problem that I can see, is if the tractor was stolen sometime in the past and reported as stolen. I know where I live, if I bought a car and if it was stolen, it would be returned to the owner that it was stolen from. I doubt that any stolen tractor would be found anyway. I would get a bill of sale for any current problems that may arise to be on the safe side.

This is a GREAT site! It"s 9:30am and I already have really good advise. I"ll get a bill of sale ready, give the guy a call,... and take a nap! LOL I plan on using the tractor on my place only, so road travel is not a problem. I really appreciate the wisdom in everyones input/advise. Experience is key. I"m sure you"ll be hearing a lot from me. Thanks.

Here in Pa., a tractor may have a title, If it is to be used on the highway, and/or driven long distances, it is to have a Special Mobile Equipment license plate. A certificate of origin, then a certificate of title is required to get the license plate. Custom operators should have the SME plates. The Farmer/owner, going between his farms, and related businesses, does not need the paperwork or the SME plate.

The answer to that question probably depends a lot on where you're at. Where I'm at, we most certainly do require title, at least to get a licence on the tractor. We are required to have a plate (a no expiry, once in a lifetime) for legal road travel. We have bought gear from neighbouring provinces that don't require title, and it's a pain, because title has to be "created". It's a real pain if you can't follow the machines ownership history back to the original dealer. Then somebody's got to 'bluff' a bit. Might be worth checking with your local DMV to see what your local laws are concerning this. HTH.

Tooth n Nail, Most states DO NOT use or require any Certificates of Title or similar Registration of personal property such as farm tractors, however, its more of a local and State practice so check with your local authority.

As noted below a properly executed (Date, Price, Description of item sold including Model and Serial Number, signed by the parties) "Bill of Sale" can provide good admissible evidence concerning the sale and ownership and can help to establish the buyer purchased "for value and in good faith" which could help if any issues ever arose.

My best free legal advice would be to obtain a Bill of Sale and then take posession of the tractor and be happy with it ever after.

Get a bill of sale and his signature on it to prove you own it. I have never had a title to any of my tractors, but I only keep them on my property.

Back in the old days, many states did require licensing for tractors and you could get a title. I have several tractors and have an old title for one of them. It is a curiosity.

As Brad said, get a bill of sale and enjoy the tractor.

A title for a tractor? Uh oh then I will be in trouble, I don"t have any titles for my tractors. Just have him make out a bill of sale which includes the sellers name, buyers name, the item purchased, the date, and an amount. Make sure that the seller signs his/her name to the paper, then you can also sign it after you get home. That way there is some amount of proof that a transaction had occured. Just my .02 cents on this. Hindsight is always 20/20 right. Been there Done it
