Discontinuing renting of land notification

Any advice on proper ettiquite as to notifying the renter of farm land that I will be NOT renting out next year, and rather farming it myself. I know the farmer aint gonna be real happy bout it, but small or not I am money ahead sowing it myself. I'm proud to be one small farmer starting to grow, rather than another bowing down and out.

Stop subsidies, consolidate farms to max, wait short time for dry year and large farmers with25% of crop will then tell consumer -My price is double what you have been paying, pay or starve or eat a politician. Government will then send troops to take food stock, Troops recruited from farm families will then shoot officers and politicians. Starvation time and revolution possible. Slight variation of Russian history-30s in Ukraine. Amish probably survive though. RN.

Dave, thats one of those type things thats often based more so on local practice n custom then any general state statute (In Pro Judge Indiana its the Judges Court and how he decides or rules is pretty much it lol). HOWEVER if there is a state statute thats the best place to start from and follow to the letter what it says regarding times and form of notice like written or verbal etc.

As an attorney I agree with the advice below to first give him the courtesy of face to face verbal notice (keep a diary/ledger of the time n place and particulars and any witnesses, a non biased witness is better) followed up with a letter mailed in the US Postal Mail with either Proof of Mailing or even Green Card Return Receipt cuz it serves as good admissible evidence for any factual dispute

We went through this befor--it can get real touchey in most states. For instance here, if he is summer fallowing, you are all ready commited for next year.
Check your state law. I all ways recomend TALKING TO HIM.

In Iowa, state law sets the date you MUST make notification by, or the contract is automatically renewed for another year. I think that date comes soon, like Sept 1.

Better check MN law to determine what is your legal obligation to him. Many times state laws are very specific in your obligations.

Do you have a contract with the current renter? Many standard rental contracts require you to notify the current renter by registered letter prior to September 1 if you will not be renting to him for the 2007 year.

Just as a courtesy, go see him face-to-face and let him know, and then follow up with the letter. Some farmers are already buying inputs for next year, and I"m sure he"d appreciate it if you gave him the heads-up that he wasn"t going to be working your land next year.

No Contract, he has just been stopping in and dropping off a check and having me sign the form that he is farming the land for the program payments. He didnt even ask what I wanted per acre the 1st year here, just paid what he was paying the previous owner. I raised it to a more average rate for this past year, but as I said, if I can make even $200 NET PROFIT THAN RENTING IT OUT. i NEED TO DO IT. Whoops hit the caps butten. I'll check with the extension service and see what the law is and then as you stated talk to him and verify with letter. It is a touchy subject and I am sure he'll say I 'm not gonna make any money, but it seems alot of the guys saying there is no money in farming are the ones wanting to rent your land, there is a reason why. Failure is only an option of many.

Rent you can sit back & cash the check.

Actually farming will be an education. :) $200 net - if you ignore land cost - is possible I guess. Repairs can really mess up a person's plans on that tho.....

Corn is under $2 a bu, beans are around $5. It's hard to net $200 with those prices, when fuel is $2.70/g & fert is $25/a.

Of course, I'm in the same boat you are, so don't let me sound negative. :)

Well, yes, but renting you deal with the the large equipment rutting the drive and around the pond. Ya deal with feeling like a tresspasser on your own ground. You have equipment parked around the land for years ( eyesore, critter homes) you deal with cashing a somewhat small check while you see semi loads of 150+/acre corn coming off your land, then you find out the farmer gets more per acre from programs than he pays in rent. Every one like a 3-5% raise in there salaries right, well this will be my raise the next few years- provided my plan works as it should.
