Alright, right here we are having the worst drought ever. Ya all know I am done renting my land this year. 4 times in the last week I have driven by a feild that is rented by the same farmer that rents mine. The irrigation on THAT feild was running all 4 times. Normal right? Well it would be if something was planted in it! It was never seeded in anything, its not even tilled just full of everyweed you can imagine. But..... .. the irrigation on my property and the one behind,which was notilled in beans thicker than grass, he has not ran the irrigations AT ALL. What the heck, they are all dying. The heavy ground on my peice them beans are almost 4' tall and thick, now they are dying too. I want to call the renter and ask what gives but figure I'll get a " mind yer own". Any one have any insight why a unseeded weedy feild (40acres) would be getting watered, and the 100+ acre of beans here under pivots in sandy soil are being allowed to dry up? Is there more money in crop ins payments and fed aid than the net from harvesting and watering? Could the elec bill from one big sprinkler be used to show " hey I ran my irrigators , see?

Are you cash or share rent? Share rent I would be in his face and looking for a new renter. Cash rent who cares, however if he don"t do a better job than that the rent just went up!

If the renter is looking for an insurance payout I'd advise him that the crop insurance boys are using satelite images that can tell wether the crop was irrigated and if it was sufficient. Seems the Office of Inspector General is leaning on the local Farm Service Area offices to report any people in "non complience with their paperwork for payments I know someone that is appealing a decision. It's not me however. Jim

Stop in and talk with the renter. Ask him how the crops are doing, start talking about the drought and the heat, and casually bring up the situation in conversaton. Mabey he's got a good reason. Hear him out and just let him tell you whatever he's willing to, don't be pushy, just nod your head. Think about what he says and then decide wheather or not to rent to him again. At least you might get a better idea of whats going on. Who knows, beans aren't too terribly far from being ready, mabey he's hoping we'll get enough rain where they'll hang in there and he can save the cost of irrigation. It is your land and you should at least have the right to check in with him.

You should always put a clause in your lease to the effect that the tenant will follow sound farming practices. This gives you grounds to terminate the lease early if you don't like the way they operate.

I'd say Cowman's got it. Insurance. I've seen many do it around here. Don't plant and claim weather prevented it. Plant, harvest whatever grows, and claim a loss due to some uncontrolable reason.

What is the source of the water. It could be that the other piece of land has senior water rights tied to it. In order to keep the water right they may have to use there alotment or risk loosing there place (surface water rights are by seniority in nebraska and if you dont water you loose your place and go to the end of the line). Just an idea.

Are you renting it on shares or cash lease. If cash lease what difference would it make ,you're getting your money.
