OT: wetland survey by NRCS

I received a letter from the local office of the NRCS, a division of the USDA. They want to survey my land in NW Louisana before I convert some wooded land into pasture. Have any of you ever had your land surveyed for wetlands and what are the consequences if it is determined to be wetlands?

The ramifications of having wetlands on your property depend on the wetland laws and regulations in your state, and the federal laws (administered by the Army Corps of Engineers) govering the use you want to make of the wetlands.

I don't know anything about LA wetland regulations. Here in Massachusetts we have, perhaps, the most restrictive wetland laws in the nation and even here you can get a permit to convert a wooded swamp into pasture for raising animals. It's not fun or cheap to do so, and there are restrictions on what is allowed. However, it is a lot less painful and less expensive than being made to turn a pasture back into a wooded swamp.

You can probably get a very good idea as to how restrictive wetland regulations are in LA by looking at your state's web sites, and the Army Corps of Engineers web sites.

But the way, there are places where all the trees were cut and wetlands were drained. They are called deserts. Or former villages buried in a mud slide. Or former cities destroyed by storms.

There are places where all the trees were cut and wetlands were drained. They are envied as the most productive food-producing acres in the world. They feed people. Southern Minnesota, west of MPLS, used to be known as The Big Woods. Farms were carved out of the wilderness. Typical soil types in many areas are Nicollet and Webster- same as in Iowa's productive regions. But since all food comes from the store, people far removed from the source don't see the value of a farmer improving his property.

It's interesting to see and the false truths and lies that continue to grow and expand on this list. As a professional who deals with wetland issues every day, all I can say is if you wish to receive federal farm substities for your opperations, you need to follow the rules. If you don't want the federal handouts, don't work with the NRCS and they will gladly give the funds to another producer. It's that simple.

I would do all that is said here and I would add one more thing. IF you have any wetlands on your land and you dont want it there then pump the water off and make it dry land. Quick story, in Michigan a few years back I heard of a guy that dug a pond on his land and 10 years later he was going to fill it back in and the government tree huggers fined him for filling in wetlands,....what a bunch of BS.

I agree, don't answer the letters but turn them over to your lawyer. Under no circumstances do you let them on your property unless you like the idea of giving away you property (while still being taxed for it).

Don't answer the letters, and don't allow them on your property. If they knock on your door, answer it with a broken but loaded side-by-side dangling down over your arm, not pointing at them, and ask them if they're revenuers looking for stills like them other two down yonder over them hills shouldn't have oughta done. They'll head straight for the laundrymat to wash out their drawers.

I wouldn't respond back to them nor let them on my property, not without a warrant. I sure do hate them guys.

Those people are no longer interested in assisting farming. They are now keepers of the tadpoles. If you drain wet lands they can deny you the "right " to participate in federal programs. I've been working to get drainage problems fixed before they simply come through and tell us to leave areas they say are wet lands alone or make it illegal to tile without a permit from them.

Dont let them do anything you dont have to. We have some swampy areas on our farm. Two interns knocked on my parents door and asked if they could "look for turtles". We said no. It turns out they were looking for endangered bog turtles. If they find any they put it in a database and it limits what you can do with that area. I had to get a permit to replace a bridge on our farm lane and the NRCS man ran a report to make sure they hadnt found bog turtles in that area. They hadnt since we didnt let them on the land...

around here, "wetlands" is the tree hugger codeword for land use confiscation

but they still want taxes kept current by the "owner"

The salmon laws and wetland laws of Snohomish county in Washington state claimed over 2 1/2 acres of my 7 acre place with no compensation and no use of the affected land. Not only that it was still included in the taxes on the property. Now I remember why I moved ! LOL

You lose. You can appeal to the local FSA committee. But they have no power to overturn dinglenutz's 'decision'. You can appeal to some offrice in Indiana and have the right to attend the meeting they set up. I wanted to tile land that has been farmed for 50 years- they used to go by crop history, like cropped 7 of 10 years. That system is changed, bottom line is that more is determined to be wetlands. You lose.

If they declare part of your property "wetlands" and you have a mortgage, next thing that'll happen is your lender will demand you carry Federal Flood insurance.....
