Got my tractor back, not fixed.........

I need advice on where to turn now. Got my tractor back after local dealer had it for 2 weeks and it still has the same problem with the hydraulics as before. There service department is a mess (lack of qualified tech.) I went to pick it up last week and they didn't even have it back together correctly. Leaking fluid on the floor and hose clamps not installed correctly just some of the noticable problems. Should I take it to another dealer and send the bill to the first guys, or let the first guys try again at no cost to me?? Small claims court or what?? I never been in a mess like this before. Bill is at 1033.00 right now. Need my tractor fixed correctly!!!! but also need it in the field this weekend....What would you do?

as far as court goes forget small claims unless your state is different than most as they don't even have to show up! if i had to go that route i would put the money into superior court (hire we fleece em good and howe) and go after them big lost work damage etc a 50,000 suit would get the managers attention fast.

There is not many lawyers that can fix his tractor but plenty that will take more of his money.

Harley said it right.He[the shop] has been paid over a grand.Go back till they get it right.If they have that sign that says "nobody allowed in shop for insurance reasons" ignore it and watch the mechanics every move.Remind him how a mechanics reputation should mean everything to him.They cant charge any more money because they been paid and it aint fixed.Keep on the individual guy working on it until your happy.Involving a different shop,lawyers etc is just money wasted.Dont accept any bad workmanship.Still be freindly but clear that they gotta fix it right or you will tell everyone in town how they failed your job.I would go back and just tell him its not right and your not leaving untill it is.

I'd be somewhere in between havvey & the rest.

If you _need_ the tractor & do not ever trust this dealer again, then chalk it up to experience & go elsewhere. Pay for parts put in your tractor, I'd kick & negociate on the labor part of the bill. you did get the parts, the labor was worthless, pay for what you got. But realize if push comes to shove you could owe the whole bill.

Most of the time talk to the guy in charge (owner?) and find out what the 2 of you can agree on. Free loaner & get it fixed right & no more labor costs would be kinda where I would want to stand, you decide.

Forget the lawyer his bill will be double the bill you hold now... Small claims court will split things down the middle, & it is up to you to collect then anyhow, so you won't get much and they frown on you witholding payment so .... Just how it is.

Sometimes experience costs money. Ticks me off when I need to learn things too.

I don't agree with the others on being calm! be polite not violent but be very firm! I would go to the head manager and lay out the problem i would tell him if i felt his repair dept was crued and give him a set of terms fix it right refund money etc and back it up with the fact that you will notify the state on any professional licence they have also better b bureau. save court for a last option. if it an older tractor you may not have any recourse through the company but if it is a deere or case ih etc i would call there head office. also put a stop pay on the check/credit card until you are satisfied. you wil get there attention exspect them to be less than happy but arn't you?

They couldn"t have done much repair for only $1033,probably 1/2 or better was labor.What kind of tractor? What"s the problem?

Jim, I echo what Allen & Ken said. ABOVE ALL...Be Calm, Be Nice & Smile even if you would rather yell your head off. You can catch more flys with sugar than vinegar!
Talk to the Shop manager , then the Owner if possible to get you problem resolved. Belive me they do not want bad press on the street about thier shop. Shops are the lifes blood of a dealership. The good press you put out to your friends and neighbors can be of most value to him, for you will tell All, to take their shop work there to get fixed. Then visit about a loaner, Ooooor a reduced rate on a Rental, since you were counting on your tractor being back in 2 weeks and now it is going to take longer than anticipated to fix the problem. The tractor isn't right yet!

Like Allan says, calm down first. Talk to the dealer. He should, and probably has the right to fix it first befor you go some where else. If you go some where else, you could have a real problem recovering his bill. I did this once with an Olds dealer and an auto transmisson, but I had all my paper work in order and tried 3 times with him. Is there a factor man available? I would kind of remind him that as a dealer, he has responsbility..maybe a loaner tractor while they figure it out. I have never gotten any thing in this world by yelling.

If you haven't gotten anything by yelling you haven't yelled loud enough... gotta do it as a last resort and when there are customers around, especially those city slickers in the dealership looking at an overpriced lawn tractor or Kubota or the like. Then it works real well but again as a last resort.

I can understand his being a tad bit...displaced, so to speak, and I'd say he's being calm. Probably best to go in and talk to the service manager, calmly, and give him a chance.

Now, if you'll excuse me, I'm going back to watching Easy Rider. Billy had the better Pan, if you ask me. If it don't leave drops in your friend's driveways, how are they supposed to know you thought enough of them to stop by to visit when they weren't home?

Hard to put it into words here. I'm from the old school, no patience with incompetance, and most of the time if I have to take something somewhere it's because they have the expertise to work on the problem and I don't. Having said that, I would tell the manager if all you wanted was to screw things up, you'd have left it home and got-er-done. That's why you took it in to him in the first place. At the very least you should expect the work done that was decided upon when you left the tractor. If it was not done, they didn't fulfil their part of the deal. Also if they don't give you any satisfaction, or worse yet, get smart with you, lean over the manager's desk, get right into his face, and tell him to look real close, cause that's the last time he'll see you in his place, and every person on the street is going to hear about how incompetant his staff is. This has worked on more than one occasion for me. Nobody in business with the public wants a disgruntled customer spreading dissatisfaction among his friends and neighbors who might not darken his door because of your experience. Good luck, Harley

Harley I like your response. Kinda like what I would do. I have calmed down alot over the years and agree cussin and screaming doesn't work. I have been talking to the management and they are real accomodating, however, incompentent mechanics will still be working on the tractor. It is a 2550 Deere with hydraulic problems. I have a genuine shop manual on the way and may just put this in the shop and tackle it myself before winter. Trouble is I have done business at this dealer for the last 25 years and even bought a new round baler and a new disc moco over the years. They only have 2 employees that I know of that have been there for several years. That includes management , sales, parts and service.
I sold a new farm tractor for them to a neighbor of mine just over a month ago and they still owe him the canopy for it. Didn't have time or enough help to get out and install it onto the tractor and the poor old guy put all his hay up riding around in 90 degree temps for the last 2 weeks.
Wish now that I had never gotten involved in the sale.
Anyhow my tractor is still not fixed but my son will use it this weekend for tetting and raking while I mow and bale with the other one. Gotta take advantage of the free help over the weekend. Need to get up a couple thousand squares and some more rounds. I know Allan doesn't like squares but the hillside is too steep for the round baler.

Them squares roll right to the bottom into a nice big fat row. Easy picking up then. I have had up to 5 bales rolling at the same time as they came outta the baler. Really a hoot to watch as they get reved up pretty good going down the hillside.

I"d like to hear more about the Hyd problem. I have a 2550 with issues too.
It gets the oil hot far too hot and then it losses pressure unless it is reved up at least half way. I believe there is a high pressure internal leak in the rear end some where. I have a winter project. Ordered the tech manual and they are on their way

I sent you a mail. We will talk. The trouble with this problem is there are too many places to look for the internal "leak". Many many o-rings and tubes! Then there are the valves!
