Re: Eminent Domain - the end of crack houses? in reply to Joe MD, 06-28-2005 11:56:03
as bad as this is, maybe there's some silver lining.

As I understand it, many run-down dangerosu cities are being slumlorded by absentee owners who don't give a rats if the place turns into crack houses, chop shops, biker HQs, etc. And as the city deteriorates, decent citizens flee to the countryside, as you're seeing in most farming areas.

Maybe the right of eminent domain could help cities seize those properties and allow improvements.

Unlikely perhaps, but not logically impossible....

You have it reversed... in reply to Rick YYC, 06-29-2005 07:22:08
Many decades ago "public use" was expanded to include such slum-clearing of property that had been severely neglected.

Later "public use" was further expanded to say that if someone had a taken care piece of property among the slums, it too could be taken as part of the project to renovate the whole area.

And the Supremes simply continued down that logical road to say, well, if we clear slums to improve the economy, and we can take good stuff mixed in with the neglected to improve, then we can simply take good stuff to improve the economy, slum or no slum.

IMHO...goose laid golden egg. Local government is now abusing "public use" and taking private property too freely for the express purpose of another person's financial gain.

Time for some simple amendment to add on to the 5th amendment:

",nor shall private property be involuntarily taken by the Government for the purpose of financial gain by another person or the Government."

(Corporations = "artificial" person legally)

(And I think "purpose" gives the wiggle room that in building a road the "purpose" is not the profit of the road builder)

Around here in my area, suburbs of Pittsburgh, PA., the really big homes are being "bought" by either Chinese, or East India Indians! We have 2 plans of homes nearby. The smell of cooking curry has driven more than one Caucasian out of the neighborhood! I've never smelled it, but i've heard it really stinks up the neighborhood. Another "plan" is being taken over by Chinese newcomers! Won't be long until they'll be wanting us old folks out of "their" neighborhood! I've heard both ethnis groups are attending borough planning committee meetings, to get the things they want put into law! i went to several of those meetings, and all i got was the feeling, if i wasn't on the take, my ideas didn't hold water: "Sit down, Mr. Jones, you're out of order!" Well, since i'm almost 81 yrs. old, the borough soon will have thought up ways to take my home and put me out on the street, and nothing i do can help the situation! Anything to help the "furriners"--the heck with the older self-sufficient residents--out you go--we need your property to beautify the neighbor hood, so the imports can feel right at home! whose ancestors didn't come from across a sea to begin with.

"Natives" included.

They bitched about the English and Spanish and French.

The English bitched about the Irish.

The Irish bitched about the Polacks.

Etc, etc, etc...

Anybody...excepting criminals...who has the get-up-and-go to leave their home for a better opportunity has my support.

Immigration is a much different issue than private enterprise using the government to re-appropriate economic resources.

Personally, would like to see someone go after the building they reside in, and turn it into a revenue generating hotel. Let the Supreme Court (Justices) be relocated to some smaller building a few blocks away, down some dark, grungy alley. They don't need that huge, beautiful, non-revenue generating building at my tax payer dollars expense. Let someone take it from them, fill it with rooms and rename it the "Supreme Hotel".

Heard also that there's a bill coming up for vote in a week or so from now to allow illegal aliens to draw on Social Security (that they never contributed to in the first place), and have the checks mailed to their home countries. No joke. Knew that the Congress and the Senate had it tabled, didn't know it was up for vote like NOW. Wouldn't be a bad idea to give our legislators earfulls on that. Email them to death, I do. Can't Email the Supreme Court persay though.

It could be worse - up here the powers to be want to claw back the extra $$$ pensioners are on and give it to the new comers. The powers to be also want to subsidize their income so they can get their families over here, and have a reason to stay in the small communities.

Tom, I heard that. A few weeks ago, had an instructor from Ontario, I think she said, told our class that. She works for a Canadian company, but lives in and works out of Texas on a visa. Told us that is one of the reasons she and her husband are trying to become US citizens, but no go. Went to, in theory, one of the formost legal immigration attorneys, a "who's who", whom told them to save their money, won't happen. They are middle class income, and that's not whom are being allowed in, or desired. No joke. Very nice lady, and knows her equipment.

One thing you have going for you up north, you have a pension. A federal judge ruled a couple of weeks ago that United Airlines could default on the pensions for their employees, since they were the sole contributers, not the employees, and are in finacial dire straits. When I think of the number of US companies that are in financial trouble, who's pension funds are way under funded, that judge opened the flood gates to hell, legally. I foresee bad things for at least the American employee. Good, or better luck to you up north.

By the way, is it over for the NHL? Just so many times can watch Slapshot and old game films before start getting the shakes.

So you mean Canadians have to sneak across the Mexican border now?On a serious note I think Im going to find a good high school team to watch.I saw a kid in the paper saying how he appreciates all the new fans his hockey team got last winter.Im going to watch high school instead of the NHL and be appreciated.Imagine that.

Is nothing wrong with that at all. High School or College hockey works for me too. So does farm league. Used to go to lots of Black Hawk games, and loved the old barn. Messmer doing the National Anthem, the crowd stomping our feet as he was winding down, making that place shake and rumble. That was the best part of the game. If you missed that, missed the game.

Just the same, is only one sport in my book, cold steel on ice.
