Hoo boy- I'm caught in the middle of a real mess.

Some 5 years ago when I bought this house in the country, I got to know my neighbor. He had a farm with all sorts of junk laying around. When he showed me around the farm, along with 3 farmalls, I spotted an old John Deere B. I asked if he wanted to sell it, and he said no.

Over the years, I would periodically ask him about it. Finally, last December, he stops by my place and tells me he is ready to sell the tractor- and it has to happen today! So, I paid him and we dragged it a mile or so back to my place, after putting on a new tire in the front (both were flat and rotted).

I rebuild the carb and get it running enough to drive on and off a trailer, so I can move it to my new farm, which I have now done.

So last week, along comes a fellow asking about it. He says that the tractors and other equipment did not belong to the guy that sold it to me, but were actually owned by the very wealthy woman who owns the farm across the road. She just got to wondering about the tractors, and found out they had been sold, and she was peeved!

I go to visit her, and bottom line is that she says she wants her tractors back. I was very polite and indicated that I have begun restoration and her response was "go ahead and keep restoring it, but she wants it back". I thought that was a pretty mean thing to say.

The fellow who I bought it from talked to her, and they disagreed on ownership, but he agreed to undo the deal and buy it back from me. He claims that she gave the machines to his mom, who is now gone.

The problem is, that I've done work to it, hauled it, and I have been planning to restore and use it. The old woman is really just trying to prove a point that she is not about to be ripped off. If she ends up getting it back, it will sit in her barn, rotting away. I tried to talk her into getting the money back from the guy and giving the money to her, but she says the money means nothing to her and she wants her tractor back.

I dunno- it seems that if she was really concerned about these machines she would have looked into them at least once in the ensuing 50 years or so since they have been sitting in this guy's barn!

I was advised by the old woman's farm manager to just hang loose and let her cool down. Maybe I'll end up with it after all. But I don't want the tractor if it will have "bad juju".

I know that the farmalls are out of state at this point and getting them back woudl be very hard.

I don't know why I'm posting this- I am mostly just venting frustration at finally getting the JD I have always wanted, and may end up loosing it...Thanks

If she persists, give her a bill for storage, $100 per day x 4 years. There is reasonable, and unreasonable. She's being unreasonable, so checkmate her a$$. I'm certainly no lawyer, but I'd like to think that there are laws that pertain to such things as leaving goods on some else's property for years at end, and then trying to reclaim them.

As for "bad juju", sell it, or find a witch doctor to put a spell/hex on it, find and put the biggest bow on it, then park it on her porch in front of her door.

Knock the tag off that ol girl ( I do mean the JD) and tell her to prove it, and then charge her for storage...THAT was a good idea. Taking the high road is the honorable and best way to go, BUT sometimes you just gotta take care of numero uno! As far as it having bad JUJU, it only has it if you let it. My buddy has a tractor, case DC,that his best friends grandfather flipped over back in the 50's, killing him. My buddies best friend (the grandson) restored it two years ago, and flipped it off the trailer, killing him. My friend will not part with that tractor to save his life, now.

If they have been sitting on his property for yours and the old bat has never paid him storage or called him to remind her they were hers. Then he can claim assumed ownership. In ILL were I live I legaly took 3lots from a family I mowed these lots for 7 years and not once did they say a word or protest after that long I claimed them under the assumed ownership law they were P.O ed but tuff I got them fair and square.

I don't think so. I have a conscience. I don't believe it is right to take anything from someone just because you can, even though it is through their ingorance or maybe their reluctance to confront you about mowing their lots. Maybe that's why I'm poor today and will be tomorrow too.

By taking this property I cleaned up a real eyesore these people were lazy slobs running down property values. rodents and and other things were damaging others property. what I done benifited everybody in the area they would all disagree with you.

I for one appreciate your response. I have been a little surprised at the reply"s on this thread. It seems to me both men involved at this point know its the old ladys tractor. THen if its hers, any truly honest person would let her reclaim it in some reasonable settlement. No , you shouldn"t take someone"s else property just because you can.

But the law says any thing you leave behind on others property and you make no attemt to remove or claim said property you lose any and all rights to said property . simple the old bat no longer has any valid claim to said property IT'S THE LAW LIKE IT OR NOT.

Belive it or not allen it's an old law still on the books in this state. assumed ownership law lets you claim property that still belongs to someone else. Just like I said I mowed these overgrown lots for 7 years owners never said anything or tried to let me know that it was there property. so after 7 years I can go to court house and assume I own it bacause I maintained it this long and owners never disputed me doing so. So I get a deed even thou they paid taxes all this time. They just forgot to remind me that I was on there property. some land grabbing scheme the gov thought of years ago.

Texas has that too. If your/neighbors fence is improperly positioned and has been that way for more than 7 yrs, he can't claim any errors. If the error is in your favor (with a subsequent survey) tough luck for him.

Allan,

Some states have an "adverse possession" law. Mine does. The law says "if you make open, notorious use of land for 10 years you own it". Much of the land here is owned by speculators. Those who don't visit it for 10 years find they no longer own it. Like any law, there are some legal technicalities but that is the essence of it.

I belive that its called "squatters' rights" here in nebraska. Have seen this before. A lawyer moved a trailer house in on a lot. No one told him to move it for 7 years it set. He then declared squatter rights getting a deed for the land... Yes land 12 acres. The lot was part of a small section of land. Made a public announcement in the local paper that no one reads and the land becomes his. Unlawful but not illegal??

Yup, squatter's rights, most every state has some version. It's there to iron out border disputes. Applies moreso to land property, but some states will have provisions for property such as tractors.... Like, in this case....

Like the other posts I'm no lawyer, but it doesn't sound to me like she has much of a case, even with the old bill of sale. The guy says that the machines were given to someone in his family, and the fact that the old woman hasn't bothered to do anything with them in nearly 50 years supports that, at least in my opinion. Beyond the fact that she has the origional bill of sale it's all a he said-she said matter as to ownership. Anybody could find a bill of sale somewhere for a machine that old and if they were able to track the machine down they could claim that it was theirs. It sounds to me like she saw the machines start disappearing from the mans farm and caught wind that he was making a little bit of money off of them and decided she wanted a cut of the pie. Good luck, I hope you get to keep your machine. Personally I believe someone that would just let one sit and rust for that many years doesn't deserve to have it back...even if it is "legally" theirs.

It's realy not your problem. If the man sold you property that was not his let her file criminal charges against him. Then if it can be proven you will loose the tractor and you can go back and sue the man that sold it to you for damages.

Hello,
In my area, The law states that if something has been on someone elses property with nobody claiming ownership for a period of 6 months, the person who ownes the property the item is on can automatically claim ownership. If that's the case where you are, You are OK because it had been sitting on the guy's property for years, until he sold it to you.

If the woman gave the tractor to the man's mother and she passed away the original owner does not have a claim to it. It would have then been part of her estate and gone to her family, which is who you bought it from, right. If you do give it back, I would certainly charge for the work done on it. I would also ask the woman if she has proof that she is the owner.

Haven"t read the replies. I can understand your frustration. These types of tug-of-wars go on all the time, usually with property lines, for decades & generations & you are in the middle of it.

I am a simple dirt farmer, no lawyer, so my advise is worth little. I believe if this were a million dollar item, the following would happen: Initially the courts would say the old woman owns it, give it back.

On appeal, the courts would rule some type of abandonment, it belongs to the fellow.

And now to you, so it"s yours to keep.

but, that would be thousands of dollars of litigation....

I would let things simmer down a bit, see if the lady will take the money that was involved, rather than the tractor.

If it looks like you have to, or will, give it back, I would take off the parts you improved. That is your sweat & equity & you worked in good faith. She is welcome to buy back those improvements; you are returning the basic tractor which you thought you owned in good faith. She is not entitled to your sweat. If it doesn"t have a carb, gas tank, tires, etc & whatever, it really did not have those things at the time you bought it either. She is not, in any way, entitled to a running tractor with new parts.

My opinion. Give the simmering down thing a good long try - she is in a tiff with the fellow, you are on the sidelines & try to stay there, out of the "game". Things can work out if you are a diplomat about it.

durn mess. sorry to read it. old lawyer once told me that pocession is 9/10ths of the law. let her stir up a hornets nest before you give in. my bet is she wont. not unless she is prepared to lose in court. a hole lot of questions will be asked in court-- like whyy the heck didn't you get them machines years ago?, an what rent did you pay when the neighbor kept them machines housed?, etc. seems unreasonable for her to claw on you about it. its up to her to recover them machines. yours looks like the easiest one to get if she dont care none about the laws here in the old dominion, right? sit tight and lock that old thing up, thats what i would do i'll tell you that. if she comes for it with writ then file suit for storage and repairs? dunno, durn mess. sorry to hear it.

Just like the others, I'm not a lawyer, but I'll throw in my two cents. I'm in agreement that you should keep the tractor in your posession until such time as she can prove ownership. A bill of sale from whatever year would pretty much be worthless without a serial number on it, in my opinion. Maybe inform her that they built 300,000 or so JD "B"s and that without a serial number, she's going to be hard-pressed to prove it was hers. I would also contact a lawyer before contacting the police. Do what he or she says. If you are an upstanding citizen and acted in good faith, I seriously doubt you have to worry about any criminal ramifications. If you do end up having to forfeit it, make it known that you expect to receive some compensation for your time and trouble in doing what you've done so far, and possibly get paperwork to that effect. Get estimates from some independent mechanics and/or JD dealerships on how much it would cost in labor for them to do a like amount of work, and have receipts for the parts you've installed. If it looks like it's going to cost her money to get it back, she might change her tune. Letting her "cool down" as her employee said is probably a good idea, as he likely has a pretty good idea of how to deal with her. If all else fails and it looks like it's going to cause a bunch of hard feelings or ongoing trouble, you're probably best off to put it back to as near as condition as when you got it and let them come get it. I definitely wouldn't haul it back to her though, as that would be tantamount to admitting guilt. And she doesn't deserve to have that over you.

I've dealt in tractors enough I've saw all kinds of things. What I would do is stop at the Sheriff's office & tell them the whole story. show them the check & offer to have them make a copy. the response you would get here is "that's not our problem" or we don't handle that type of compliant. Just tell them you just wanted them to know your side if anything comes of it. Than just wait & see what happens Get a firm price on improvements you made to the tractor. Let both the lady & the guy that sold it to you know what it is & say refund MY money & pay the bill or I keep the tractor By the way 10 per day outside storage is legal in my state inside is more .It won't take to long they will think it's not worth it

Well I didn't read far enough and didn't see the part about the Bill of sale.. with that said, there still may not be a serial number on the bill of sale. you have not broken any law that I can see, but I didn't finish law school so don't take my word on that. if I had the tractor I would remove parts that I installed, I would remove the tires and put the rims back on. I would keep the tractor locked inside and wouldn't give the serial number to anyone, and when she or anyone came for the tractor they would have to produce the serial number. Redmud:

Lynn, I don't know the law where your at, but it's my understanding here in Texas that old tractors are like guns, if yours comes up missing you best have the serial number if you plan to get it back. old tractors come up missing on farms and no one hunts for it because the owner didn't know the serial number. do you reckon she has the serial number???

Looks like you have been in possession of this item for quite some time when it comes to legal matters. Depending on the state you are in; you have a few options...but here is what you should do.

1) Hold on to that tractor for now. Keep it on your property under lock and key. If they come and collect it without a warrant, they are breaking the law.

2) Do you have a lawyer who handled your real estate transaction? If so, contact him for a free consultation...he will know your states real property laws and could give you some informal advice.

3) The woman's Bill of Sale means shinola. I still have the Bill of Sale for the first lawnmower I bought new years ago. I sold it for cash, no bill of sale was exchanged, I certainly did not think about giving the buyer one, but imagine if the guy resold it to someone else then I decided I wanted it back. Where is my proof of ownership? I think I would be SOL, and the old lady is too.

4) Don't put anymore work into the tractor for now, and keep receipts for anything you added if you can. You may need to establish in a small claims court that you have a vested interest; and if you improve the tractor any further the value of the property will increase. If your state laws vary depending on the value of the property, you may need to sneak the value under $1500.

5) Don't be surprised if you receive a summons for small claims court; and if the tractor somehow is taken from you, don't be afraid to file a small claims action...it costs very little and you have a good case for either outright ownership or at least some payment from the old lady for $ you invested.

BOTTOM LINE--DON'T ROLL OVER TIL YOU RECEIVE LEGAL NOTICE!!! You purchased the tractor in good faith.
In court, remember never to waiver from the idea that you honestly thought that mr. farmer was the rightful owner and that you knew this to be an honest deal due to your long term knowledge of the tractor.

Goodness. This sounds like a mess. I can see this going a couple of ways.

1) You have a cancelled check showing you paid for it fair and square. If the guy you bought it from can prove he was the rightful owner, then it is yours to keep and give the old bag the middle finger. If the guy you bought it from can't prove he owned it, then TheRealRon is probably correct. If the old hag reports it stolen, you are now in possession of stolen property. It is likely you wont get in trouble but you will lose the tractor. Title/proof-of-ownership means everything.

2) Have a sit-down with the old hag and ask her what it will take for you to keep the tractor. Let her know how important it is to you. Basically, try to appeal to her sense of reason. If she has none, then tell her to come and get the tractor if can prove it is hers >>> make her show you the receipt/title/bill of sale. Charge her storage until she comes and gets it. AND make your barn to most expensive storage in town. Kick the guy's rear that sold it to you after he gives you all your money back PLUS what you have spent on replacement parts. I agree with the other post that you shouldn't assemble anything on the tractor if she wants it back.

I would consult with the police. Then if the tractor is hers get my money back from the guy who sold it to you or he will be guilty of theft. Then put the tractor back where you got it, moon the old bitty, and kick the jerks butt who sold it to ya.

Sorry but it does not sound like keeping the tractor will be more touble than it is worth. Also do not re assemble it if disassembled, that is the jerks problem who sold it to ya.

Did you pay that guy with a check?

You "might" lose that tractor, but if you have a cancelled check, it 'taint you who is in trouble, it is the other guy if it was, in fact, she who really owned the greenbean.

I wouldn't get too excited about it. If anyone gives you any guff, produce that cancelled check. You bought and paid for it..... .(so far).

Oh boy..what a pain. I think I would get the money back from the guy who "sold" it, then strip off all the parts you put on, and slap the old junk parts back on. Then just put it back where you got it, and chalk it up to another of lifes experience.

My guess is that the ol lady is a miser and could not care less about that tractor, but even though she will never use it, she doesnt want anyone else to enjoy it either.

If her estate later decides to sell it, I wouldn't buy it back then either...let the heirs squabble over it with the estate attorneys skimming off their "fair share" of any funds derived from the green iron.

If she had any brains, she would work it out with you two now as its far easier to split the loot than the tractor when she is gone....but some people are just unreasonable, and not worth fooling with.

The work I have done is to completely rebuild the carb- all painted up and pretty. So, I can't really take it off. Boy does it run great!

I replaced one of the front tires. I reckon I could take it off, but the old rotted one is gone anyway. And I put in a new battery.

I understand....but in my opinion you will waste far more money, time and hassel messing with a lawyer than the carb., your improvements, and maybe even the tractor are worth.

I still would take the tire off, keep the new battery, (throw in an old one), and if at all possible find an old carb to bolt on, and get it the heck out.

Lynn,

Set tight. You bought it in good faith and have invested a certain amount of money in the thing.

Let the others fight it out and if push comes right up next to shove, demand your original payment plus the cost of your improvements before you will relinquish the tractor back to anyone.

This whole mess is not your fault.

Talk to your lawyer in the meantime.

One of the problems with getting legal advice in a tractor forum is that you have gotten some very bad advice.

You need a lawyer, pronto. In my state you are in possession of stolen property, a felony. It matters not the circumstances. You cannot say "oh, gee whiz, I didn't know it was stolen!". If the owner reports it stolen and presses charges, you'll have real bad "juju"!

Yes. But, can the lady prove ownership????? Does she have proof of ownership? Hard to claim possesion when it's on someone else's land for so long.... In a story like this, a sheriff is going to act _real_ slowly..... .. They can read between the lines. Assuming this fellow has a bill of sale. He can get dragged down, but only if the sheriff happens to be the old lady's nephew or something. ;)

I agree advise here or any discussion forum is worth what you pay for it or less, from any of us. But sounds like he looking more to vent, than to get legal pointers.

Hi Lynn,

If you have a "bill of sale" and there's no title then it's your tractor.

The lady could only collect from the guy that sold it to you. Hows she gonna do that with the tractors setting on "his" property, no bill of sale or title ? She's a done deal.

With a bill of sale your free of the deal unless a title can be proven.

She apparently has the original bill of sale when she bought the tractor back in '47 (i'd love to see that out of curiousity!).

When I bought it, I didn't think to get a bill of sale. I did pay with a check, and she now has a copy of that check, and seems satisfied that I paid the guy for the tractor.

The guy and his dad always farmed the woman's land and did mowing and maintenance. I think what happened is that after they stopped farming her land some years ago, the tractors fell into disuse, and the guy sorta figured that she didn't care about them. After his parents died and it was time to sell his farm, he decided to sell the tractors.

He sold me the JD at a rock bottom price, and I think that in any event, he would be happy to buy it back from me, even if it doesn't make its way to her.

One thing for sure. I'm not hauling it back. It just *barely* was able to fit on my trailer, and the load on my Chevy 1/2 ton truck was a bit much. They will have to come and get it with a rollback at their expense.

Hi Lynn,

Well you just learned a lesson about getting a bill of sale on anything you buy more than $250. In most States anything that cost more than $250 is a felony only if you know it's stolen or wasn't his to begin with.

I would get a bill of sale from the guy, then check with the county attorney for his advice for your State.

From what you now said, your gonna loose the tractor unless she lets you keep it. I then would get another bill of sale from her. If she wants it back, depending on what the county attorney says, you will probably have to haul it back. I would say your not in a position to argue any point other than how much a$$ to kiss.

While I do not know the laws of your state I will say this.
If someone / anyone left their tractor sit in my barn for 50 years without once checking on it I would not even care if they thought they still owned said tractor. I would sell it and not think twice about it.
Tell the man you bought it from to tell this old lady that he wants 50 years of storage fees. I think that will get her to packing.

Lynn, I ain't a lawyer, and I don't play one on teevee, but I'm guessing that a good legal case could be made that you own the tractor. If it's been abandoned in the other fellow's barn for decades, and if she knew it was there and if they didn't have a written agreement otherwise, I'd suspect she gave up her claim to it. Kind of like adverse possession, though that term normally applies to real estate. Now, that said, I suspect it would cost you a bundle in attorney fees to prove it, or to defend yourself against her attorney trying to prove otherwise.

Soumds like a case of abandoned property, you have the check and the dispute is between her and the person you bought it from. With you in possession of the item with proof of sale no ones going to come up with papers after so many years. Another writer said charge storage suggest $500. per day, don'give in.
