OT have the mower AND the money...now what?

About 4 or 5 years ago, I sold my dad's Case T-10 mower on this site. The gentleman sent half the money with the promise to pick it up and pay the rest as he moved across country. Well, he went ahead and sent the other half of the amount and never has picked up the mower. Dad has tried to contact him a couple of times with no luck. Anyone know what to do now? I have another guy that might be interested in it, but dad does have the full payment from this other individual. What would be the right thing to do? We can't hang onto it forever in the hope that he'll come get it.

Its stored on your land, isnt it? You still paying taxes on it? Inside your building? Its yours til he takes possession of it. Possession is 9/10ths of the law. You can't hold it forever. Guy gave me $500 deposit once & never came, never answered mail or phone messages. Just dropped off the face of the earth. Kept it couple years, then sold it. Actually thats pretty common; they lose interest & just drop it. Not your fault.

try posting an add on this site asking him to contact you. run it ever two days or so for two weeks and see if he contacts you.

I bought a combine off of this site in Mich somewhere sent the money and have had the computer and email crash since then. On second computer and third email service since then. Have replaced and updated antivirus so somewhat safer however even MSN has wiped my archived email, which is supposed to be on my computer not theirs. Have no idea of how to contact him as I don't remember his handle. so have decided to place an add here and see if he responds.

You have what is referred to as 'unclaimed property' and would be governed by the laws of your state. Check on line for your states Secretary of State or Attorney General. They should have a link as to what you do. Most places you cant add storage unless it was in the origional sales contract, legally title reverts to the state after a period of time in which case they would tell you wheather to sell and deposit the money in the unclaimed property fund or what. Bottom line is it is his mower now.

the 1 year storage is a valid point you could resell and if you felt good return the money if he evercomes back (maby hes dead)

Well at first thought I thought you should sell it and hang onto the amount of money the first buyer paid you incase he ever came back. It would be "extra" money if you sell it again. And what about storage charges? After a reasonable time you would be justified in charging storage I would think. On second thought, you have the money, put the mower someplace out of the way, reasonably covered or protected by someting, and forget about it. If you are really short of space or are moving, well I don't know. You might consult a lawyer if you could do so without it costing you much or anything, freind of a friend, or relitive maybe?

Aaron, I believe the right thing to do is to wait until contact is made with the person who paid for it. Perhaps something has happened to them beyond their control. Since you had a offer for sale and you accepted payment, the mower may not even be yours to sell any more.
