John I found my mothers life insurance on missing money.com. They want to know if estate is open or closed and probated. I told them my sister did what she wanted and told me there is no money left. I doubt that she went to court at all. There was supposed to be a will, but disappeared. Only concern I have is that state will keep like $500. if I answer incorrectly. Is it illegal not to probate an estate? I would like to talk to you is possible or email. Just general info. as I am lost. If you can help. Thanks.

Like has bene said, contact a lawyer, the probate laws vary by state. for example, the last I knew , in Mo. you only had to probate an estate if ti was over 100k.

Thanks fellas. Just want to keep my sis out of jail and have one of us get the money held by the state. Interesting note from SC. She was born there.

Go to a "City Lawyer" and ask them. A good lawyer will save you money and reduce the number of sleepless nights. If much money is involved, go to a "City CPA" also. Both of these are well worth the money when trying to settle estates.

No lawyer, but in SC its illegal not to probate. The descease may have had some unpaid bills,loans, etc. which if it meant selling her personal property to pay them, then it had to be done and was the executors responsibilty. An ad in a major area paper should be run so that any creditors could be notified as to the death of the individual, and had a cetain amout of time to response. If you sister was the executor, she would be intitled to the money, and she would do with it what she wanted. With no will, her property should have been divided between her children, or closest kin.
