I was playing around on ebay a little while ago when I found an item for sale that used a pic of one of my tractors,its not saying the tractor is for sale but they put the pic of my tractor on an item and are selling this item.They did not ask my permission to use the pic,and Ihave contacted them to let them know about it,and they basically emailed me back and told me tough *&^%!Once I put it on the net,it belonged to anyone that wanted to use it.Is that true and what do you recommend.I contacted ebay and gave them the number and theemail between me and this other guy.Just makes me kinda mad,they could have at least asked,Id said yes!

to my satisfaction!Guy agreed to stop using the pic.Time will tell!I really dont mind the fact that hes using it,its just Iwished hed asked first.Like I said,Id said yes!

Cubber, check the link below. I believe they prohibit the thing you refer to and remove the auction. Happened to someone I know where they had "stolen" a pic thinking it was harmless. Ebay removed the auction listing. I agree that you should be able to have a say in what your tractor appears on or in, and if profit is being made off your tractor, you deserve a piece of it.

It has been going on for years.

I'm a musician and have been putting my recorded songs on the net for about 10 years now.

I'm forever running into a page from some yokel who has my music posted and saying that he is the one playing it.

The 'net is just a big give-away.

Let me guess, I'll bet that the picture is being used to help sell a tractor manual that has been put on a cd-rom, if that is the case, don't worry, those things never even get a bid.

This has happened several times to me,they posted
a picture of my tractor with the same text but
a different seller.Ebay doesn't care,they told
me to work it out with the seller,told me maybe
he didn't know he wasn't supposed to do that.

Isn't that also dishonest about the tractor? If you show me a pic of a tractor and I buy it from you, I would be hot when I showed up to get it and it wasn't the right one in the pic. Seems like false advertising to me.

Once I bought a tractor just off of a picture. I'll never do that again. It was a super m and it was to have white lights and 8, yes 8 spoke wheels instead of 6 spoke wheeles. I was very peed off when I got there and they told that was my tractor. It had poor sheet metal and the regular 6 spoke wheels. Also it did not have near as nice of paint as the one in the pictures. My brother, his friend, and I loaded the thing up and brought it home. Then after about an hour of getting homethe guy emailed me and told me that I could have the 8 spoke wheels if I brought the 6 spoke ones back and changed them myself! I was really pissed off that day.

Yes i agree with you. I sell farm toys on ebay often times and youre not allowed to show a picture thats different from what youre selling. The only exception is if you specifically say that the pic is for display only and not of the actual item. Otherwise the buyer can claim it as Misleading and take the refund insurance of up to i think $200. I don't know what the refund insurance is for the motor categories though. Just my thoughts.

Just wanted to pop in and say that your photo is automatically protected by copyright and any use thereof without your permission is copyright infringement.

Lots of info on the net, just go to any search engine and look up photo copyrights.

Copyrights are not automatic, but they are easy to assert. All you have to do is claim a copyright by stating "Copyright," the date and your name. The "(c)" also helps. If you really want to be certain, you can register your copyright with the Library of Congress. I think the cost is $20 or %25.

It might matter a lot if the photo is supposed to be depicting a tractor that is for sale. If the photo is not of the tractor for sale, and there is no disclaimer to that effect, then that is blatant false advertising. That is dishonest, and against the law.

Sorry, but I believe it's true. any pic posted on the web is fair game. of course it's a little different when they use it for gain. would have been polite to ask.

I would expect there is little you could do about it. Maybe take it as a compliment. They thought enough of it to use it to help sell their wares.
