This is a different maybe. I have a neighbor that complains alittle about my tractors and the noise they make without the muffler(7ft door on garage)even though I don't run them above a idle or past 8to 9:00 at night. But right now this guy and his son are playing the sterio LOUD and with way to much base and its is rattling my windows as I type!I also have a neighbor that a county cop and he is cool! and says he never hears my tractors(A&B)even with the muffler off. Oh well can't afford to move so I will deal with it for now I guess. Thanks needed to vent a little.

RIVET MY POSITION ON OUR TOWN PLANNING COMMISSION
IVE BEEN TRYING TO GET ALL THE OTHER MEMBERS TO
ADOPT ORDNANCES PREVENTING SUBDIVISIONS ETC,
IN OUR TOWNSHIP WE ARE A AG ORIENTED TOWNSHIP
AND WE ALREADY HAVE TO MANY CITY FOLKS THEY COMPLAIN ABOUT EVERTHING FROM BAD ROADS TO NOISE FROM ALL KINDS OF ANIMALS INCLUDING MINE I ALREADY TELL THEM TO MOVE BACK WEREVER THEY COME
FROM BUT WE NEED BETER LAWS TO PROTECT THE FARMS

Little Red,

Where are you located? Your situation with your planning commission sounds identical to what we have going on in my township. Our town is zoned almost exclusively for ag. This has really been a problem for our farmers who want to cash out and retire, yet at the same time we need to have some plans in place so that when this does start to happen we don't get overrun and end up with a huge mess.

UP UNTIL LAST WEEK WE NEVER HAD ZOINING IN OUR TOWNSHIP THE PEOPLE FINALLY SAW THE LIGHT YOU HAVE TO GIVE UP SOMETHIGS TO PROTECT OTHERS
MOST OF ARE FARMERS ARE GETTING UP IN AGE AND SOME
GET SOME BIG MONEY OFFERS FOR THERE LAND SEVERAL PARCELS NEXT TO ME HAVE BROUGHT 4.000 PER/ACRE

Red: While I agree whole heartedly with what you have to say, most townships have been so wishywashy on this it is pitiful. They are the prime reason why there are disputes.

They have been very quick to pass laws banning the use of engine brakes on trucks. Yet if you consult a lawyer on this one. He will tell you if involved in a accident with your truck every braking option on that truck better have been activated, and yes computer system on truck will convey exactly when systems were in use.

So just maybe it should be manditory for all ATV's, motor cycles, rap musicians, etc. to be equiped with computers. Probably wouldn't be so many around. But when it comes right down to the nuts and bolts of this, it takes two to disagree. most people almost never disagree with themselves.

I have ran into the same problem before. My neighbors in upstate NY didn't like my tractors, 4 wheelers, or snowmobiles. We lived way out in the country and there was nothing around us but farm land and this guy had to build right acrossed the road from my house. It became a sunday morning ritual at about 5am to go and fire up all twelve antique tractors in the barn. Most of them were built for pulling and none had mufflers so the sound was defening. We even made sure to ride the 4wheelers and snowmobiles as late as we could stay awake at night.

I was bailing some oat hay a few weeks ago out in the country and out here it's been between 90 and 100 degrees during the day. We finally got some cool weather but it was only damp at night. So, out there at 11 pm there I was on a Case 1070 and a Freeman 330 bailer. The bailer itself was really loud and the tractor wasn't all that quiet either. After the first lap I passed a house that butted up against the property and there standing in the shadows, out of the view of my lights was a man. I figured he was the owner of the house but it still creeped me out the way he was standing in the dark. He only stood there for a few laps after he figured that I wasn't stopping til I was done. Still, really weird.

Who has been there the longest? You or them? What I did when we finally got neighbors ( 1/4 mile) they complained when I was plowing about the noise so every tractor I have lost the muffler and we plow only after dark. Only took 6 months for them to move back to town where they belonged. If you are in a ag area make all the noise you want. It works here. I still farm the ground we own inside the closest city at night and as long as we keep farming it the law can't do anything about it.

i agree,here in mn those city doofs are wanting to move into the country,and first thing they start bitching about the smells,noise,the hours you work,and pretty much anything you do!we do the same thing,the one that bitches the most will have the tractor running in the field by him the latest,and if at all possible we will have it going again by 5 am (and hope it is a good and cold night so it really pops when you fire it up in the morning!)the guy is tough though,he ain't left yet.

If your land is ag classified you should have no trouble running that tractor from 5am to dark. If it isn't ag, you shoyuld still be able to run it at otherwise 'reasonable' hours.

Check out the ordinances in your area.. chances are, that your tractor is legal, and their loud music isn't.... wouldn't that be a surprise to them.

It is a pain living next to a 'bad' neighbor.

When we bought our property a few years ago, it is mostly horse farm in this area, and we are in a horse community, but the back side of our property backs up to spruce creek.. a retirement development here. I guess the people moving in didn't do their homework, and weren't aware of the AG land behind them.... The guy directly behind my property used to be a habitual complainer.. Once he even called the fire dept. on me and said that I started a fire in their community, when my fire was really on my property, and all legal.. i had all the setback requirements, I was burning in a container with a wire mesh cover, had buckets of sand ( in our area, if you burn, you have to have buckets of sand, water or a fire extinguisher nearby... they also like to see heavy equipment ( tractors ) in the area if it is a larger burn pit, etc ).

I was out tending the fire, and the fire dept pulled up in force.. on their side of the property.. looking for the fire. In the end, even though I was in the right.. they made me put it out. They quoted some law that if they show up to a fire, it has to be extinguished no matter what, etc.... pain in the but neighbor.
I fixed him good though. from that day on, I moved my maneuer/compost pile to that back section, and also put my hog pens ( 2 ) and chicken coops ( 2 ) and turkey roost ( 2 ) back along that fence.... I hope he likes the 5am rooster alarm clock..... I can't hear it , as it is so far back on the property.. but it is probably only 90ft to his door.... hope he loves the mid-day aroma as well... That's what he gets for starting out the hard way.. I would have been more than happy to have the pens a little closer to the barn.. but he made the decision for me.
I havn't heard a peep out of him since. I did get bullied a bit one time from the development thugh.. But I had their number too. When I put up my back fence, i put it 5' off the property line, so that I could weedeat and maintain my fence, and not be walking on their property. One day their security guys ran me off 'my' property while I was weed eating. I called the law, and the law called their maintenance office... shortly therafter, their main office called appologizing....

Perhaps you need chickens and hogs?

I would check the laws regarding others use of 5 feet of YOUR property. In the old days, after a certain time, you could not prevent further use by moving the fence to the proprety line. You may loose the right to use the 5 feet even tho you own it. And you may have to maintain it, too.

There is still a rickety barbwire fence on the property line from the previous owner.. I just moved the 5' in and put up a nice 3 board cresote and 2x4 no-climb wire fence. Guess I should look into periodically maintaining that barb wire fence to make sure it doesn't fall down.. looks like that is the only thing that may 'maintain' my property as you point out.

When I lived in my first home(mobile home)I had it set about 30 ft from the property line behind me.I was assured by the owner of the property tha he wasnt going to sell any of it so I thought it would be a nice place,wooded lot behind,feild in front of me and always shaded,except in the morning,and would help cut my a/c bill in the summer.Well the gentleman died about 5 yrs after I moved in so,you guessed it!his greedy children sold it all off.I ended up with people behind me that cleared the trees and set up on of those tracks for 4 wheelers.They were on those things constantly,the dust and noise.Man I tell ya,it was ruff.I complained to them as well as the law,but it never helped.So i got myself a new hobby to go along with my tractors..... .minature cannons!!!Just out of spite,Id go out at 3 or 4 in the morning and shoot the thing off on Saturday mornings!I dont know who was more happier when I moved,them or me!

I've got a set of neighbors that ride their 4 wheelers all of the time on a track that they just built. They make all sorts of noise and dust. Then at 9:00 pm 4 of them race past my place just when it's nice and quite. I really feel sorry for the people that live right across the road from them.

The way to stop the 4-wheelers is to accidently put nails in the trail, the cost of those tires can really add up ya know.

Dirt bikes and ATV's are good for nothing except raising H unless on a sanctioned track. I would like to see the things banned. I live in a rural housing development, and had problems with next door neighbor's kid. We just kept calling the sheriff until they finally got the message. Had another neighbor about 1/3 of a mile away, same thing. Apparently the neighbors next door to them got it stopped, but it went on for more than a year. I wouldn't worry about ratting on your neighbor, as neighbors like that are stupid anyway. I don't know of a more polite way to put it. The kids are young and uninformed, the parents are dumb.

I agree-they aren't poor if they can afford an ATV-and there is always the possibility if they are totally bored they could possily find a paying job to occupy their time.
