Does the local court system have jurisdiction over Canadians? If one goes into any court US or Canada you better have evidence such as an invoice,serial #,promised delivery date and any other evidence some mutual agreement occurred which has since been broken. If the seller promised verbally to send you a tractor if you first send the money then all you have really purchased is a promise. If he sends the money back you should feel quite fortunate. I have purchased tractors from several individuals and auctions in Canada. Each time that I have wired funds to pay those transactions my banker has given very specific warnings: If the deal goes bad,we have absolutely no recourse in getting your money back or getting the seller to deliver on his promises.
