Does anyone know how to contact Otto Tegtmeyer from Kansas, I have his email but he is ignoring my emails privately and through paypal. He bought a John Deere BO Crawler Parts tractor from me, paid with paypal, complained to paypal that it wasnt as described, paypal sided with me and closed the case as a false claim and I was able to keep the money that was paid for the tractor, now he filed a complaint with his credit card company and they took the $2000 out of my bank account, so now he has the money and the tractor and is ignoring me. If I dont hear from him soon, a lawyer will be contacting him for theft. Anyone know this guy? or Have his Phone Number?

I would contact PayPel and see if they could do something. I'm interested becouse I have sold things on Ebay but so far have not had any problems. What was his feed back rating?
 
Paypal got my money back the first time, but the 2nd time he filed a claim with his credit card which was out of paypals hands. NEVER accept paypal on a high dollar item. This is what will happen.

Harlan, if you are in a different state then this guy, then it becomes a federal matter. The FBI becomes involved and he can be put away for several years. Check into it. The FBI might be able to collect for you--Good Luck!
 
It's not theft. It's he-said, she-said, and up to a judge to determine who to believe, if you decide to take it that far.

His claims may be fraudalent, but he made them in a legitimate way, and followed the process laid out by the credit card company.

If he's not happy with the item, the credit card company issues a chargeback, and he gets the money AND the item.

For $2000, how far are you willing to take this? It will cost you far more in legal fees to get a judgement in your favor for $2000. Then it's up to you to collect. Many lawsuits never pay out because the defendant simply refuses to pay.

I think I knew him about 30 years ago.I looked him up and there are 2 people by that name in the USA.One is in Wellington, Kansas the other is at Marshall,Mo.So if its the one I knew that would be his son at Marshall,Mo and his ex wife is at Marshall,Mo.I think her name is Susan.He might have more kids,but one of them is Otto Tegtmeyer,III.He is in his early 30s.I think the old man is the one you are looking for,but I dont know for sure.
It says he is 72 years old for the Wellington,Ks one.That would be about right for the one I know.His ex wife might know if he is dead or not.Might be a possibilty since he was 72.

Perfectly legal through the credit card "chargeback" system.

If you aren't satisfied with your purchase, the credit card will issue a chargeback and get you your money back. You get to keep whatever you bought.

I had an issue several years ago where I bought a model railroad locomotive on ebay. Nothing was said in the description about it being non-functional, or sold as-is. It was described as being in quite good condition. When I got it, it was junk.

When I called the seller, they basically thumbed their noses at me and said, "ha ha you got screwed," so I went to the credit card company. I described the situation, and they asked me to write a letter and fill out a form. I asked if I should send the item back, and they said no, keep it as proof of the fraudulent transaction.

Shortly after I got my money back, the seller disappeared from the face of the earth. Turns out they'd screwed several people on ebay and finally decided to cut and run.

The problem is, a dishonest buyer can turn the system around on an honest seller...

Still, it seems like an awful lot of work to go through to screw someone out of a parts tractor... At most the tractor's worth a few hundred in scrap, and they probably spent that much trucking it home.
 
You would think the credit card company would have to do an investigation that included talking to the seller and asking the seller to remedy the problem or correct false claims from the buyer. Anything sold used is considered as-is unless it is stated otherwise in the form of a warranty. It's another matter if an item is intentionally misrepresented and the seller knows it. This can be really hard to prove a lot of times. If it's as simple as you say to get the credit card company to issue a refund, everyone would pay with a credit card and then complain they weren't satisfied with their purchase. In the case of this tractor, it sounds like the seller was never even given the option of returning the money and taking the tractor back. Dave
 
Credit card companies will err on the side of "customer satisfaction" rather than find the actual truth, but you do have to do some paperwork and provide documentation to support your case. This isn't something you can just punch in online and instantly get your money back. It's quite a bit of effort.

Do you recall anything from your dealings with this guy that might have set him off? This whole scenario just seems vindictive, vengeful. If you're going to ruin your name for money, why do it for such small potatoes? $2000 worth of old crawler tractor parts isn't going to get you very far, and it's a lot of work to get the money out of them.

Have you talked to anyone at the bank? They may have a way to reverse the charge to your bank account.

Pay Pal also will pass that information along to the credit card company that paid them. So you can have money taken out of the account by a third party (credit card company) that you have never done business with.

When I sell on E-bay I have Pay Pal pay me to an account that I only use for this type of thing. It never has much money in it. I have my pay Pal account set up so I get a text when I am paid. I then have the wife transfer the money out of that account and into a different account at my bank that does not have electronic access to it. It costs me the five dollars a month for the extra account but I know that they are not going to get money out of my account with out my knowledge.
