Madison County, Indiana is trying to <a href="http://www.wishtv.com/dpp/news/local/north_central/madison-county-evicts-man-from-trailer">evict Dick Thompson</a> from his land because he lives too simply. County Boards are turning into Home Owner Associations I hope heads roll the next time those jokers face election.

I was on jury pick one time for a case similar to that one. As far as I'm concerned,if there are no minors or people of deminished mental capacity living there with no choice in the matter,it's nobodys d@mned business!
Needless to say,I didn't get picked for that trial.

If he's happy doing what he's doing on his own land, how can they evict him? Being it's 38 acres, it's not like he's camped out in vacant lot between million dollar mansions. Dave

Just another fine example of people sticking their nose in where it don't belong. I think his friends and neighbors should form a welcoming party when they come to put him off his land. I also find it strange that man is the only animal that needs a sanitary sewer. Stick to your guns Dick.s

this is all over the news here...... the real problem is he has no septic system in place and his sewage is running across the surface of his property.

Every residence in Indiana has to have a sewage disposial system. Even the outhouses in the state parks here set on a concrete tank that is pumped yearly.

Madsion county Indiana is only enforcing state law.

One single man does not create nearly as much sewage as the wild deer, turkeys, pheasants, etc., and there is no law against any of those critters relieving themselves on open ground.

It"s how the Beaucrats treat the simple life people . You have to live by the millionairs standards or you don"t live there .He needs to contact that great history writing America hating president & ask him how to work around laws & the legal systems to suite his wants . But of course Mr Thompson isn"t black so that"s against him there . I"m sure if he was black , he"d have all kinds of big name law changers at his property helping him . Ya gotta love the Justice System . God help those in need .

Well, you know, I put in a new septic tank as my original one was over 40 years old and was getting soft in the sides that are above "water". I didn't get a permit and about a year after I did this, here comes a county sanitarian asking where my laterals are. Wife told him and added that we just put in a new tank. He jumped on that and said "you didn't get a permit". I went postal on him and said why would I get a permit? I was only changing the tank which is no different than re-roofing the house and I sure don't need a permit for that! He left saying I should've gotten a permit. That's been three years ago and haven't heard a peep since. Sometimes you need to call their bluff. Living on the land, I would certainly call their bluff, but I'm not sure about Indiana. They got money to build the Interstate Highway, yet charge a toll. No one complained about that. Seems the farther West you go, the more freedoms you have!

If the guy put in an outhouse then he should be good to go in my opinion. Doesn't take much effort to dig a hole and throw up a tiny structure.

If you think it is bad now just wait until the 2006 International Property Maintenance Code hits your area. City council here is planning on implementing it in a slightly amended form.

Here a ticked off neighbor can set the ball in motion which may result in an inspection. No GFCI circuits in the bathroom, kitchen, or properly grounded outlets in the house---sorry, update.
Minimum spacing for outlets--don't have enough install more. Peeling interior paint which should be no ones business---sorry, paint. Furnace that won't maintain 66º in ALL habitable rooms, fix or replace. And the list goes on. Already an ordinance that allows the fire department to enter your HOME to see if there are working smoke detectors.

My 1920s home will need to have a LOT of wiring work to comply as most are only two prong outlets. No GFCI in kitchen or bathroom. I really, really should DUMP this place now while I still can.

Sometimes I think I'm too old and it's times like this I think I'm not old enough. One of George Orwells books outlined this about 60 years ago and everyone who read it thought it could never happen.

Speaking of hogs, here in my neck of the woods we cannot have a toilet in a hog confinement if it dumps into the manure pit. It has to go to an approved septic system. Has to do with human bacteria becoming resistant to animal drugs closely related to human drugs. The hog buildings around here hold several million gallons in the pits and we all know how much a human puts out in one sitting so we are talking about miniscule amounts.

According to my local county sanitarian, or sewer guy, or whatever he's called, they aren't worried about the poop as much as the drugs that pass through our bodies. He said they want the sewage to be exposed to the bacteria three days to break the drugs down. I would think the hole under an outhouse would give it more time than that. Jim

They tried to throw my neighbor off his property because he had no electricity. The power line was a mile or so and it would have cost $1000 per pole to get electricity. He hired a lawer for $1200 dollars and went to court and won. I hope he fights them and wins.

As a resident of Madison County, I stand behind the eviction if in fact his dung is being placed on open soil. An occasional dump it the woods is one thing. An every day occurence is quite another if the dung isn't being properly buried. Probably part of the problem is he is located an a major highway and the situation is very visable.I am all for freedom , but there is some responsibility that goes with all our freedoms. In my opinion, the guy has stepped over that line.

Around here the same restrictions apply to campers as do house trailers. They have to be on slabs, ancored down, skirted, and have plumbing and an acceptable sewer system. Several local towns have adopted a minimum sq.ft regulation 800sq ft. I believe. There are a lot of people here that are building or rebuilding old homes on their own and living in campers. Code enforcment is really cracking down on them, if they arn't code compliant. Several that I have run across poured a slab for the garage or out building and parked their camper on it. They completed the sewer system to code and hooked to it, and hooked to their well. Only drawback they are paying property tax om their camper now because it clasifies as a residence. We also have a lot of "sun birds" who stay in their motor homes in Florida all winter, and then drive it up to their" little peice of paradise" here for the summer. This is a pretty sticky issue. Some towns sort of overlook them and some are really cracking down. Sewerage is the biggest issue, because of our many streams ponds and lakes. Many residential systems have to be engineered raised bed systems or storage pump systems.

I know a dude that will not alow any government folks on his land. Oh yes this is true, he will point a gun at them, and tell them he has nothing to loose as he is old and thinks he is dying anyway.

Somehow government officials can understand him, and hear him real good. I have only seen him in action a few times, once he had seven deer in his pickup, (not a single tag) and the DNR man opened the gate, and leaned on the tailgait for a chit chat ---still not a problem if a guy will shoot you.

The cops know where he livews, and all remember his name, and warnings--they overlook his issues.

He will do anything for anybody, but if you have government plates on your vehickle, you best be just turning around.

I do not agree with him always, but you never have to wonder if he will give in or not. Also you never have to wonder what his opinion will be.

In this case, I'm not so sure he is harming anyone, but it seems men simply like to have power over another man---it is a weakness we all must probably have.

You should change your handle to "SOB",that would be more in line with your thinking

Don't fool yourself! Ask any of the other Law Enforcement guys on here: They aren't messin' with him because they choose not to...who wants to be the cop that shot the sick old man? But you start advertising for him, others start pullin that and somebody will have to fix the situation!
Ever heard the song Panch and Lefty? "A few grey Federales say, they could have had him any day, instead they chose to let him go...out of kindess I suppose."

Yeah, I can see that thought running through their heads. Thing is the thought that should be going through their head is, "who wants to be the one shot BY the sick old man for telling him he doesn"t have the right to do what he wants on HIS land that HE worked and paid for....."

I say let the old man alone, it's his property, and regardless of what anyone says he won't poop enough in his life to ever make a difference to anyone. For anyone that thinks differently think about this. One man pooping for 100 years is no difference than 100 men pooping for 1 year. Before modern, indoor plumbing came into existance how many people pooped outside for how many years continuiously....and the waterways were cleaner back then than they are now.

Nowdays you have sewer systems discharging into the waterways on a routine basis for a number of reasons. Then you have the solids that are taken out that have to be disposed of too. All in all a "sanitary" sewer system isn't any more sanitary than someone pooping on or in the ground on 38 acres of their own property....

I tend to see it like I'm told my Great Grandpa did. Grandma said when the government decided everyone needed outhouses they 'made' him build one. He then proceeded to walk right past it to the woods every time nature called. His outlook, "They might have made me build it but they damm sure can't MAKE me $h!t in it". Leave the old man alone......

have been told of a man that had a piece of mountain property with a couple of tenants staying on it,a well to do lady bought adjoining property , built on it, had intentions of forcing him out because she didn't like the class of people on his property,so she could drive up values an make a quick dollar, little did she know who she was up against, he merely checks local ordinances on livestock ,found that he could legally fence his place ,an a couple hundred hogs later she folded up an left.

Why doesn't he just apply for a variance to the health code? How should they choose which laws to enforce and which ones not to?

My wife"s family is from West Virginia. Mengo county to be exact. She has a second cousin that served in Vietnam. He was in a lot of fire fights and is only one of four that made it out alive in his unit. When he came home he bought 750 acres off of a old coal mine. He built himself a house back inside a mountain side. He invested his savings in some type of bond that gives him a little income each year. He pays his property taxes. He only leaves his land a few times each year. The rest of the time he lives off of what he hunts or raises. You could not pay me enough to go on his land without his permission. I was in base camps in Nam that are not as well protected.

The trouble started about five years ago. He has his land posted with no trespassing and no hunting signs. Then these city slickers bought the land next to him. They just wanted to hunt a few times each year. So first time he saw them he told them NOT to ever come on his land. Well the first deer season they crossed over on his land and killed some deer. He caught them. He made the whole party strip naked. He then made them watch him as he burned every thing they had, guns included. He walked them to the property line again told them to never cross it again. Local sheriff came out to see what had happened. He told them they had better just not go onto someone else"s land. Each year since then some He catches some one on his land during deer season. He uses the same penalty.

This last year they got a new game warden. Found him hand cuffed naked to his truck. It seems he could not identify who did it to him. LOL

Her cousin is not crazy. I see him about once every other year. He is amzingly smart. Reads several national new papers everyday. He remembers everything. HE just says that he left his mountains once and he not going to again in this life.

I'd trade this old man for one of the neigbors I have in a heartbeat. If some one from IN wants to come get the good deacon and his family I will take the old guy with the camper.

I have an acreage with a septic system. The city limit is right at my property line. I had notice from the city a number of years back that my property and a large number of other acres were now included in their sanitary sewer district. If a city sewer line is ever run in front of my property, I will be required to hook on to their line. My share of the assessment to hook on would be right at $2000 which at the time seemed high but now it would be a bargain compared to a new septic system. I don't know how they would force me to hook on but I am sure I would have to pay the assessment along with my real estate taxes. At home growing up, everyone had an outhouse at one time. The well for our drinking water was 40 ft. deep and maybe 75 ft. away. It was a small town with small lots and everyone's was that way. Was always good tasting water though.

Up until about twenty years ago our neighborhood had a couple of bachelors who who lived that way. One in a house and the other in a small mobile home on separate farms about 3/4 mile from each other. Neither one had plumbing or phone but both of them had electricity. Their sewer was a 'thunder jug' or a pail. They threw it somewhere outside but in the forty years I knew them I never saw where. Both of them were in their mid-90's when they finally moved to town. Both of them had only been in the hospital once in their lives when the prostate plugged up. The one that lived in the house never washed his clothes and never took a bath but he was the kindest person in the world who had the neatest smile and he was as healthy as a horse. I'd stop by to say hi nearly every day and one of those times a friend who came with me about lost his cookies when he stepped inside. I was used to it so it didn't bother me. Today,20 years later, the health and zoning department would have kicked them out of their homes and made them move to town where they would have been in a less healthy environment living around the public. Jim

Whats the difference if my neighbors dog takes a crap once a day in my yard or if the neighbor takes a crap once a day in his yard? Is dog or cat or coon crap better than human crap. Out house was out here for 30 years and never hurt anything. In Delhi India they have 20 million animals and 20 million people peeing and crapping in the streets every day. Somehow they manage to keep going.

There is nothing wrong with an out house. Water is saved by not flushing. When it becomes full right up to the seat, simply drop big rocks on it to pack things down, when it becomes time to move it, get some help. put a flower sack over your head to keep the smells out,and watch where you step, by cutting two peep holes. The Liberals think they own the next guy's property.Actually they do,the only time that we own it is tax time.
We used to have a lot of freedom here out west (Oregon),but the more people that move here the less fredom we have.

I know all the dispatchers, and law inforcment county wide, and they will all let you know, not to tick him off.

A dude was drunk, in the mans yard, and was in the mad mans vehickle trying to start it--the main mans wife called the cops to report a vehickle that was about to be stolen. There was no cops in the area till she said who was calling. When the cops got there the main man had a gun to the drivers head to help him sober up. There is no way he would have shot the drunk, he isn't that way at all.

The offences he does, aren't a big deal, but most of our government folks need to think twice before they get in someones face over a small item.

His farm of 300 acres plus is totaly land locked by state government parks. He stopped farming, and put everything in set aside. No one would blame him, as his crops were the target of all food for the deer, and turkeys.

The man has no enemies as far as civilians, but government seems to get under his skin. He has several apple trees, and many shrubs---anyone that has been around deer knowas what they look like. Not a twig as high as a mans head.

Every year they harvest around fifty deer off the farm, DURING SEASON.

In his defence, he has seventy five percent of the folks in the comunity that think he is heaven sent for standing up to the government officials that try to dictate his life, and everyone else.

For instance, the deputy that told him he could not run his four wheeler through the camp ground area. He has to do so to get to his farm, and timber land because of a trout stream. After a heated discusion, and the facts brought forward the problem went away real fast.

We as friends, actualy stir the post when we kid him, just to see the smoke roll out of his eyes. It provides alot of entertainment to say the least.

One evening a guy stayed over, and slept on the couch---he wasn't real sure it was a good idea when the 30-06 barked out the window at three AM. It was just the old guys way of chasing off the deer from his apple trees.
