Hope you have a good insurance co.
2 weeks back my daughter was on the 4 lane, right lane, when she approached an overpass at a clover leaf.
A car shot off the entrance ramp into her lane. He was traveling so fast that he was out of controll, clipped her bumper as he passed, crossed the inside lane, bounced off the guardrail and came back and hit her left front fender so hard he pushed the strut tower into the engine compartment.
spun her crossways in the lane totaling both cars.
He doesnt want to see the cops so he dives into a friends car that was following him and leaves the scene.
Cop says by the way everything looked he agreed it was the other guys fault, and my daughter did all she could.
Next the insurance says that because only front end damage to daughters car she must have been at fault and will procede that way.
They now have the poliece report and still havent changed their minds.
Daughter is out her car and still owes the difference from est value they will pay and what is still on the note.
A black mark on her record as the cause.
And now they say they will buy him a new car to boot.
He had a 2009 F Focus with no valid insurance and ran, most likely was DUI, Too fast for the intersection, Left my daughter holding the bag and he gets a new car???
They need a new mascot. Trade that green lizard for a Opossum, THey just roll over and play dead.

Tell the idiot you want to go over his head. Don't settle for the first or second offer. When they say that is the best they can do, tell them to shove it.
Ask him for the number of the insurance commissioner.

I'm in one of these battles myself right now. The lower level monkeys are trained to get rid of you quickly. Become a thorn in their side.
 
I had trouble with liberty mutual. Guy ran a stop sign and because I hit him it was my fault. They took it to arbitration and admitted it was their fault. Still nothing, so I wrote to their CEO and everything was resolved quickly. Slugs at the bottom aren't working to help you. Good luck!

Just let us know what insurace company it is and we will be sure to avoid them . If they get a bad reputation they will take notice if none of use buy there insurance. Word of mouth is the best advertising
 
You need to go over his head to his boss or insurance commissioner. The insurance company does not decide who is at fault; that is the job of the police and the court system.

On the other hand I do not understand your laws. Leaving the scene of an accident is a big No No and makes you at fault. Plus we have a no pay no play law. If you do not have insurance you get nothing even if the other guy was at fault.

Not always.

My brother and I were following an old man driving a Suburban. As we reached city limits the highway turned into a 4 lane. He wondered over to the right lane and we started to pass him. He turns his left blinker on and turns left from the right lane. My brother locked up the brakes and hit him in the rear quarter panel. The state trooper ticketed my brother for improper lane change for some reason. Upon review of the accident photos the old man's insurance paid for the damage to both vehicles even though the State Trooper defied all logic and physical evidence and wrote my brother the ticket.

But in this case it sounds like he needs to get a lawyer and force the insurance company to pay. Even if it is the other driver's fault if he doesn't have insurance the daughter is still stuck with her deductable. You can sue him for the loss but you would be further ahead and more rewarding to just kick his arse. Bums like that don't pay their bills.
 
I agree with the others. You need to go higher on the food chain. Contact your state insurance board and spend maybe $100 and have an attorney write a letter.
 
My wife was driving down the highway , a women came out of a motel parking lot and rammed into my wifes right passenger door, knock my wife into the left lane , then this women proceeded to keep on driving away , she stopped about a mile away came back and cursed my out for hitting her, her point was she didnt have to stop ,there wasnt a stop sign comming out of the parking lot, the lady was charged for not yielding to the right of way leaving the scene of a accident, even lost in court the case , She never reported the accident to her insurance company so they said it never happen even after we sent the police report and court case verdict to them , they never paid for her car, our insurance company did after I got in touch with insurance commission, we had to pay the deductable, I dump our insurance company , after all the troulbe ther gave me to get my wife car fixed ,told them they insured me, fix this car now ,get your money from the gulity party insurance
 
If your daughter got clipped in the rear first, that normally should put her in the clear from the start. Usually, anytime someone get's hit in the rear it is the other guys fault. Good luck with it.
 
I think you need to read some of the other replies John.There was a case here a few years ago,where a man passed a truck turning left hit the truck,admitted the turn signal flashing and guilt,found guilty in court.Allstate ins.came back and said the truck should not have been turning left and sued the truck driver and his ins.co,went to jury trial and lost their case and as far as I know NEVER did pay for the truck damage.So in some cases ins.cos. rule more then the law.
 
Agree do not roll over. Refuse their staement and ask for the supervisor and keep asking until you've got the CEO. Don't worry it won't go that high as someone will want to look like a fool.

But if you want to talk to the insurance commisioner don't ask the insurance company look it up--that a state office.
 
You need a lawyer. Most insurance companies will push you as hard as they can, but if you lawyer up, they know the party's over, and will get reasonable in a hurry. But as long as you proceed on your own, you get nowhere.
 
Go to your state insurance commission. You might first try going to a supervisor/executive with the insurance co. Going to a lawyer and a lawsuit/court will probably eat up a substantial portion of a settlement, so use that as a last resort. An attorney's advise might be money well spent though. What ever you do, don't roll over and play dead for a deadbeat insurance company.

In Texas, an insurance agent cannot by law become directly involved in a dispute between a client and the claims division. This is how it was explained to a jury I was sitting on a few years back.
 
You know who her insurrer is if you see any of the adds, the talking lizzard with the Australian accent.

I know a girl whos car sat totaled in her driveway for over 2 months because a guy ran into the back of it and he had the lizzard ins also. Thats why when my gf rolled her exploder i told the guy to tow it to the lot to help speed the process along. It still took forever with her insurance (no lizzard). She didnt fight enough IMO, it rolled over because the road was a pos and wash boarded. The tow company said it happens every few weeks. She was going under the posted speed limit. I was with her. It all happened very slowly. Now whenever i'm on a dirt road i dont go more than 20 mph, usually between 5-10.
 
My wife hit another car with my pickup. It totaled the little car and did $1,700.00 to my pickup. We took the pickup to a local body shop. The insurance told my wife that shop didn't work with insurance. WRONG. after a couple of weeks trying to talk sense to this dumb broad, and the body shop having an adjuster from our insurance co. in the shop for another car. My wife got ahold of a supervisor. We now have a repaired pickup.

The insurance can have its point of view but at least in this state they are no better than anyone else.

In the case you stated. Allstate did not pay on their own. They went to COURT and won.
Why they won may might be a whole differant ball of wax but at least they won in court.

The same holds true for police. My son was in a head on accident. Cop said it was his fault. We got our car fixed by our insurance under collision.
We then went to court and was able to prove from accident pictures the other person crossed into my sons lane. I was refunded my deductable and my insurance in turn sued the other insurance for their out of pocket cost.

That is why we have courts. To settle things like this. But a insurance company can not just pay because they see it a differant way. They have to prove the officer was wrong in court.
 
Maybe I wasn't clear or you misread,Allstate "LOST" their case and never did pay,Agent tried to help the truck owner later but I don't think the owner ever got anything.
