Cash rent question

I did not send the renter a notice this fall. He did not send me a notice this fall. Does that mean the terms from last year apply to 2010. I would like to raise the rent for 2010 but dont know if I can. Good renter and pays on time, but I think I am in a bind because he is related.
 
Read your lease that you & the tennent signed. It will spell it out clearly. Most leases state that notice needs to be given before Sept 1st. Because he is related has nothing to do with this. Gerald
 
Back on the rant.

In Washington, "notice" wouldn't matter a whit. But then, we haven't had a legislator who knew anything about farming since 1928. They don't have time to be bothered, they're too busy giving my money to the feckless, the hapless and the hopeless.

You're probably in "farm country", where notice might matter. Or maybe not (are you sensing a trend here?). But unfortunately, we don't know where you are.

If you're going to ask for legal advice, start by telling what state you are in. THE LAWS ARE DIFFERENT, depending on your state! The advice you get will still probably be worthless, but at least it narrows the field a bit.

If there's no written lease the your both free.You can raise the rent if you want to.I have year to year tennants and we usually don't discuss rent till spring,plenty of other people are looking for ground to rent if there not interested.I could get more money,but i have good renters who pay on time and do a good job.
 
I think it is just common practice to give notice in the fall.If you have a good renter it may not be to late to talk to him about it now.I am looking from the renters side as I rent a fair amount of land myself.Would not like to hear that you are going to raise the rent on me in the spring.
 
Our lease contains a clause that states that any change in the rent must be agreed upon by both parties by September 1st of the preceding year.
 
Most states have laws that if nothing is written down, the lease would continue for one more year unfder the same terms of the last year _unless_ you give notice of a change by (Sept in my state, other fall deadlines in other states; and spring deadlines in some winter wheat growing states).

So if push comes to shove, your renter can continue the next year under the same terms in most states.

That doesn't mean you can't talk about it, but you should know you are on thin ice.....

In Illinois notice of change in lease ( oral or written) must be made by Nov. 1 to vacate property by Mar.1
 
I have lease agreement , spell everything out starting date to ending date , If I dont say anything about a rate increase they keep on paying as nomal and the agreement is extended for a another year,I dont raise the rent unless, my morgage- escrow goes up so much I cant afford to eat the cost but never if our agreement is still in affect
 
In Iowa, your stuck if you don't send notice or don't get notice by Sept 1st.

Really isn't very nice to decide to jack the rent this late anyway. It would be nice to tell him now or in the next couple months that rent will probably go up for 2011
