this is the first time this has happend but had to put on new battery now as so as i put on hot wire it start cranking with key off

My first reaction to your statement is that the starter switch has not released from the last time you tried to start it. I assume you have the push-down type of starter switch which, when it works correctly, will ground the wire to the relay and activate the starter. Chances this relay has stuck in the closed position.

I knew a fella who replaced his OEM safety starter switch with a key switch (the OEM switch cannot be depressed for starting WITH the tractor in gear). He was in a hurry to start the tractor one day. Without sitting on the seat he turned the key, unaware that the tractor was in gear.

That lil ole 8N started up and ran right over him. It took him just shy of 6 months to die from the injuries.
