Looks like we lost a couple farmers

No not to death. But one younger fellow grew pumpkins and a few other things on the side. Due to price and other factors he threw in the towel. #2 Another grower was farming some land on a verbal deal. Was in and started some tilling when in came a couple machines and a pick up. He asked what is going on here? ANSWERE: you tell us we are the new owners. The guy that owned it did not even tell him it was for sale or he sold it!!! You have to love some people!!!
 
Our son bought some land in WI last winter that has some rented out farm land. The rental agreement is on paper and carries over but I have suggested that he should at least talk to the renter on the phone.
 
Even a verbal agreement is in force unless legally terminated by termination date. It may not be worth the fight but the rental agreement would stand up in court.
 
Lots of problems with that including costs to fight it.It'll all depend on what the previous owner says was the agreement might even say there was no agreement which is what the new owners
might have been told.He said-she said usually gets thrown out of court.
 
Depends a lot on state law as well. Iowa has a very strong law on this, oral agreements and all need to be terminated in writing by September 1st I think it is? Other states are much different or more difficult to enforce a verbal least beyond one year. Sure not good of the landowner to clear up before selling.

Surprised pumpkins didn?t work out, thy tend to be a lot of work but anything decorative people fall all over themselves to pay extra for. Not like food, which has to be super cheap for people to buy..... little sarcasm, but kinda true.

I agree, it may not be worth the fight. I realize Iowa is a very farmer/tenant friendly state, but here, it is explicit law that the owner must terminate a rental agreement, even a verbal agreement, by termination date or the agreement is automatically extended and enforceable for another year. Termination must be done by certified mail or delivered by an officer of the court. And the rental agreement extends through transfer of ownership. And this law has survived many court cases.
 
I lost one place last year and another one this year. One got sold and even after I told him I wanted it again if he wasn't going to work it,he rented it to somebody else. The other one was sold for less than half the price they gave me on it. Oh well. I've got four other landlords in their mid to late 80s. We'll see how the next few years go.
 
Generally around my parts everything is verbal for the most part. New owner bought some land we do and started out good and is still good, but he changes his mind every time I see him on what he wants. It really amazes me how people from other areas have a totally different perspective on things. I'm from a tiny town...a township really. My word is golden as is most people's, but you get people from out of the area and they are so paranoid that you are going to screw them over. Must be fun living in the city i guess. Pretty frustrating when people do things like rrlund is talking about. Money, power, possessions are great (and I like money), but when my time is up...i like to think people will say about me what Josie Wales said about Jamie (the boy who got shot up) "I rode with him...I got no complaints."
 

Also, there a few instances of someone buying land and thought they could take immediate possession with no regard or respect for the previous owner/tenant.
 
Hey a lot of em don't know anything and no one says anything to them until after the fact. Most of the city people I don't think are being jerks. They most likely bought through a realtor and are not aware of laws regarding tenant farmers.

Now the guy who pulls into a field with equipment? Most often he knows what the story is. But he figures he can bully the guy with the beat up old equipment. He's right. Most small guys will pack it in right there. Most can't afford a lawyer.

Here it seems most of the rent issues stem from long term local farmers messing over their friends and neighbors.

My SIL's brother tried pulling a fast one. Rented 160 tillable acres. Then without talking to the owner put in alfalfa. Owner figured out what he did and gave him notice in writing. SIL is a good man. His brother is a POS. Anyway he tried to lawyer up. Was kinda funny to watch form the sidelines. The brother? Dad even kicked him off the farm this past year.

But neighbor messing over long term grew up together neighbors is the norm here.
