update: cash rent roundup ready beans/no rent payment

Lawyer said to file an eviction notice at court house. The renter did NOT want to communicate.

I told him i would be willing to void our 3 year contract or he would be evicted plus i would see him in court to get a judgement for unpaid rent.

Now I have a weedy bean field that will be sprayed next week approximate cost is $250. Lots of marestail (sp?) Which is roundup resistant. Wonder if it may need sprayed twice before harvest? Then pay to have beans picked and hauled to elevator (approx 2mi). Won't get rich but not a total loss.
 
Can't help much with the legal side but check price plus harvest cost to make sure its not a loss for you. I am assuming you do not have harvest and spray equipment. I see a fellow one time take a crop (lien) for payment and still lost as it cost $10 to make $8. Yes also check for liens he may have a fertilizer or other lien and if he fails YOU COULD BE ON THE HOOK FOR THAT IN AOME STATES!!!
 
To be safe I would give your county sheriff a heads up and run that idea past him before before taking any action. He probably handles evictions several times a year and can advise you about what to do and what not to do.
 
Where are you located??? At this late date spraying to get the weeds under control is needed. The trouble is with mature Marestail I do not know of any chemical that will kill it and not kill or hurt the soybeans. If you really hit the weeds hard you can easily stun the soybeans to where you may not get a crop. If the beans have not been sprayed at this late of date I am not sure the beans will yield enough to off set your cost of chemicals and harvest.

Without seeing how bad the weeds are it is hard to advice you on what to do. If the weeds are terrible you maybe better off in the long run to spray hard and kill everything including the beans to stop the marestail from producing seed. A single Marestail plant can product tens of thousands of seeds. You may have trouble finding anyone willing to harvest the soybeans if the marestail is very bad. We cut around any marestil we see in the field. We do not want it in the combine to spread to other fields/customers.
 
Sounds like it has worked out about as well as could be expected. If you haven't done so already, I'd write up an agreement saying you will void the lease and not try to collect rent with the understanding that he drops any claim to the crop.
 
Why not find someone to cut them and bale them for hay.Several years ago a neighbor had a weedy field and just used them for hay.
 
I'll stick with my previous advice- plow it all under right now. You get a season of green manure and kill the weeds. Worst case scenario, you pay him for his costs incurred to plant your cover crop, call it a lesson.
 
we hsve a field hat was mostly marestail last year. We then rented the field to a farmer who planted beans this year, He sprayed the fields a month ago and those beans are absolutely weed free. Not a weed of any kind, just beautiful beans. The lane was sprayed also and it looks like a roundup burn. I heard last fall of a roundup for marestail but didn't follow up on it. HTH. HenryO
