Dual wheel falling off update

So now the insurance is saying that they won't cover the damage to the other guys truck . They said they will have to put the damage on the other guys policy .
 
Then that policy will sue your policy.. and your's will end up paying it any way...I have seen this before...
 
Which, for no fault of his, is now going on his record. Not fair at all. Not that a real accident is your fault, but it is similar to dropping a chunk of rock. Jim
 
Tell the other guy not to file a claim with any insurance company.
He should instead sue you for the damages, which your insurance will have to pay.
Been there done that.
 
I just hope it will get took care of somehow the guy the Tire hit has been a friend of mine for a lint time
 
But suing me might cost him more than just paying the deductible. I told him I would help him pay the deductible
 
Something similar happened to a friend of mine some years back. One Sunday morning he is driving along with another friend headed for breakfast and some guy oncoming crosses the center line, headed right at them. My buddy swerves, goes up on the curb and sidewalk to get away and still got side swiped in his new Ford F150. The cops come out, they exchange insurance information, and not only do they have the same insurance company, but same agent. Some fine print in the policy and hard feelings later, they end up splitting the costs through their own policies and deductibles, and because his policy had to pay for the damages to his vehicle, more fine print about no "Ford original" replacement parts, but aftermarket instead. My buddy was pretty upset.

Yeah same here, went back thru 5 pages and don't see the story on this, a search with his username doesn't turn up the story. Maybe it was a coffee shop discussion he thought he had posted here instead!
 
This is one of the reasons I tell you guys to take your tires to a shop to be repaired or replaced. If the vehicle that lost the tire was not overloaded, it is a good possiability the tire shop could be liable. As I have said before to the guys you try to save a few bucks fixing your own tires--- Make sure you have millions of dollars in liability insurance it ain't "when are you going to need it but how soon are you going to need it!" I've had to testify in a few and the results for the poor slobs trying to save a few bucks have NEVER been good.
 
I once owned an Ace Hardware store. I would haul 4 or 5 pallets of concrete mix from the plant, about 80 miles away. Had an old 2 ton chevy, just put a new set of rear tires on a few days before. I loaded up and stopped by my daughter's appartment. I parked the truck in the alley behind her appartment and went to lunch with her.I came back, got on the interstate and started home. The steering felt a little strange, like maybe a low tire. I decided to stop at the first convienent place which was a roadside park several miles down the Interstate. I pulled off the exit, when I slowed down to about 30mph both right duals came off. One went under the truck and bent the driveshaft. This old truck had 10 lugs on it with castle lock nuts but they held on both wheels. I checked the lugs with a wrench at least once after I had the tires replaced. I expect someone took the lugs off and tried to kick the outside tire off but the load was too heavy. Every sack of concrete mix was in place after I stopped.Real rough landing though.
 
The story is on here somewhere and I did have a tire shop do the work and I also checked the lugs twice after having the new tires put on with a snap on torque wrench
 
So we just shouldn't fix anything for fear of liability? Tires are not rocket science, which is good cause most tire shops I been in are far from employing rocket scientists.
 
Do what ya want but this is the second wheel I've had come loose after a tire shop worked on my rig they take a half inch impact and run em as tight as they can then take a two dollar torque wrench and jerk on it like a monkey so I think I'll be torquing my own lugs from now on
