OLD MOONSHINE STILL / Legal to sell ??

I have my Great Grandfathers Old Moonshine Still, it is complete and in very nice condition. I would like to sell it, but would like to know first if it is LEGAL to "SELL & OWN"??? If anyone is interested in it, Email me and leave your Email info or contact number, i have many pictures of it. Thanks.
 
My understanding at least for New York it is legal to have as long as you are not selling "shine." Even so you will become unpopular with certain portions of the population and they will be itching to stick it to you. Best to keep that information to yourself normally.
 
Location? I would like to find a still for our farm museum. We could pay a little for one. We are always looking for old farm tools & equipment.
 
It is probably legal to sell it, but not legal to use it! Museum would be the best place for it. If you sold it to a private party and some related incident resulted in a lawsuit, you could find yourself included in the lawsuit.

If someone drank "shine" and then an accident resulting in injury or death, whoever sold the still could be held responsible for a portion of the damages. Remember, lawyers always go after whoever has the money.
 
Why do you want to sell it?
Seems if it was your Great Grand Fathers still, it would have lots of sentimental value within the family?

You can own all the stills you want. Just don't make any shine.
I can't believe the number of people that think you can make so much shine for your own use. Just cannot do it!

look on the net. you can buy brand new ready to use whiskey stills for "display use" only :shock: but you cant legally distill one drop of whiskey

You can distill water through them but that's about it. So you should be able to sell it or have it as long as you ain't making shine.

I was at a very large farm auction here in Tennessee about a month ago. Not one but Two rather nice stills advertised and sold. Was noted there that it was not against the law to own one just could not produce spirits with the thing.
 
IIRC the BATF could charge and try you for "conspiracy in the intent to distill" meaning if you buy anything with the "intent" to produce untaxed liquor you can be found guilty of a felony. And like so much of the BATF stuff it seems their burden of proof isn't all that great. Yes you should be able to sell the still but I think I'd get a notarized statement from the purchaser stating their intent is for something lawful, especially if you're not an external_link supporter or they might try to get you on the conspiracy charge.
 
You could "de-activate" it so it isn't functional when you sell it. I would not plug the cooling coil without providing another outlet or do anything else that would let pressure build up inside, it could explode.

Your county sherriff can tell you the legal ways to sell it.
 
All depends where ya are I guess...here in NY wich is one of the most restrictive States about personal liberties in the US, you can not only own a still, but you can produce with it provided it is for your own consumption! I'd love to own a nice old still, but after building and using one of these new recumbant stills, I doubt I'd ever use an old one...too labor/time intensive!

It is legal to sell and its legal to produce as long as you have everything in order with the BATFE.

Warning-Classic Joke alert!
The case law of haveing without actual use comes from a moonshining charge by possesion hearing of farmer caught with a non operating still- the prosecuter noted the charge was based on possesion of equipment capable of doing the illegal act, so charge was made even without evidence of actual moonshine produced. Defense argument from the farmer was statement to judge: May as well charge me with rape as well since I"ve got the equipment capable of doing the illegal act- and no evidence of actual doing the act. Judge said good point, charges dismissed, record the judgement for rest of courts to note--and chuckle over. warned ya. RN.
