ot: legal: advice might be needed

My wife has been married before. He was abusive, and threw away all her photos, etc.

She just got a letter from a life insurance company, yes for real.

Her ex husband has passed away now, as have all the other relatives.

His mother bought 2 different life policies with her son as beneficiary. He is now dead before his mother.

I am going to take this to my lawyer. Is there any way the courts could make her liable as the mom has been in a nursing home for a long time?

If I'm understanding the question correctly, you're not asking about your wife being a contingent beneficiary of the life insurance, are you?

I think you're asking if your wife could somehow be held liable for her ex-mother in law's nursing home bills. Short answer is, no. She is no longer married to the guy, and has no obligation whatsoever to his relatives. Actually, children are not responsible for their parents Medicaid reimbursement, except that any money and property they might eventually inherit will have to first go to pay off Medicaid, before the heirs get anything.

I aggree with Mike 100% (If she was divorced) However if her name was on a life policy as the payee-benificary 1.she could be in for a large check!!!! 2. see a lawyer in your state!!!

I always come here first for all legal, medical and dental advice.
Do yourself a favor and see a real attorney.

Not to hijack your thread but is anyone on this antique tractor site using a Dremel tool to fix their own cavities?

Cavities? No but I did smooth off a chipped tooth. 600 grit on a rubber backer, hardest part was remembering to move my hands in the opposite direction as things looked in the mirror.

I just dont see how this relates to the origional question though....

drsportser,

Your comments make me laugh, both at the ridicule, and the truth of written word.

I suspect you are nuclear-trained, and have made the derivative of common conversation methods your prey.

No compliment or disrespect intended.

I love the replies.

You wife should not be liable for her ex mother in laws bills, unless there was some money or assets being moved around in the past 3 years to hide them from the old home.

Then anything is possible. They will claw back on that if they see an opportunity.

As they say, my word is just opinion, see a lawyer for a real answer.

doug, in Ill., The answer is NO, But go and check with your Attorney.
The Life Contract is a totally different matter. Your Wife's Ex was Beneficiary in a Life contract. If all others Close Family Relatives are Deceased then the Company is backing up the line of relatives to fined the Next-of-Kin! Divorced or Not.
Your M-I-L Nurseing Home Care is probably under Medicaid rules, if the Lady Owns no Real-Property for the State to attach a lien to then the Life contract was there as a plan for the Ex-M-I-L as a Burial Policy (Per-say) which is allowed it couldn't be a policy that made Cash-Value! (internal rule.. as it pertains to Medicaid recipient Qualifications) they can't attach a lien to that (the Life Contract) for the benefit of ther contract does not belong to Ex-M-I-L, She is Deceased, it belongs to the Beneficiary's ... your wife. Hope this helps
Later,
John A.
