i bought 3 weeks ago 2 stacks(150 rounds) of hay from a neighbor 12 ml down the road.We shook hands on it. but i wasn't gonna pay till i could actually load.
Fella had to plow the snow to make room for loading but his tractor was broke down, he was gonna call me when the tractor was fixed and the snow cleared.
Wel i never got the call so i called him last night to ask him if his tractor was running again so i could come get that hay before i run out of hay at home.
Fella said yea the yard is plowed come anytime,I ain't gonna be home in the next couple days so you have to load yourself,the tractor is sitting by the stack
When i got there this morning i find there's only 19 bales left from the 150! :shock: The scumbag sold them on me! :x
What the "ELL is wrong with people these days?Just about every friggin neighbor has stood me up at one time or the other
 
I sold the same tractor three years in a row. All three times they were going to pay when they came to pick it up and ask I not sell it in the mean time. I am going to sell it again this year but guess what? If I get the same story and no cash when who ever promises to pay when they pick it up and some one drives in with the cash, it will be gone. Cash talks
 
Shaking hands these days don't amount to much. Get it in writing, pay for what you buy and haul it away right away!!!! NEVER let it sit and promise to pay when you pick it up. What you thought was clear in your mind was obviously not clear in the mind of the seller.

I've known guys who bought and paid for things at an auction and didn't go back to get it for 4-5 years -- and were mad that it wasn't still sitting where they left it.

Looks like"SOME BODY"has a couminication problem. When everyone but me seem to have lost thier mind,I generaly have a talk with the man in the mirror. :wink:
 
I have advertised stuff to sell, and some one will
call up and say, consider it sold and never show
up, and maybe I could have sold it, but was
waiting on the guy to show up.
Any more when some one says consider it sold, I
tell them when I see the money in my hand I will
consider it sold.
Unless if they are away from here and say what
time they will show up, I wait till that time and
if I don't get a call from them I will sell it to
the first man that has the money.

In your case he should have called you up and told you there was a guy that was there that wanted them. Do you still want them? I've been selling some hay, and some of it was some rained on stuff from 2010, it's some of the crappiest hay I've ever seen. I listed it on Kijiji, described it as very low quality. Guy called saying he desperately needed it. We set a time for him to pick it up. Never showed, couldn't get ahold of him. It's sold now, to a guy that actually kept his word. I'm not saying that you weren't going to keep your word, I'm sure you were, but if the guy has sold some hay before, he may have assumed that you weren't going to keep your word, based on the fact that you didn't keep in contact. It may have just been a miscommunication/he misunderstood the deal.

There are a lot of harsh comments here. Am I missing something? From what I read, you came to buy the hay, he couldn't provide a way to load it, or to even plow a path to it. He said he would call when he could plow it out and load it, and then, he never did. So what you are saying is, if you would have gotten a phone call, the hay would have been sold.

I don't see how that is your fault. I would have never paid him for the hay in advance. That's how people get burned.

Sad to say that I think everyone is becoming complacent. It's just easier to not care anymore about others since God doesn't exist anymore.
 
Gonna tell ya something... if I had a dime for everyone that told me they were going to take so much hay and consider it sold... I wouldn't have to make hay. So it goes something like this today. I have regular customers who I store and hold for... and if they screw me once it'll be the last time I hold hay for them. The rest is sold on a first come first serve basis. You get screwed a few times and left sitting on hay you tend to get mean after a while.
As far as the tractor being broke or snow needed plowed... if you needed the hay that bad you could have trundled a tractor down there, plowed the snow and loaded the hay out. Then you'd have it.
Yeah, I know he didn't keep his word... him and lot more today. Such is life.

The tide turned when the seller said HE would call when snow was clear! That meant HE was in charge of the sale. The only thing the buyer could've done was pester him often to see if snow was clear. Sure cash in hand is great but he did say he would clear snow for him. A simple call by the seller when path was clear would've prevented all this. And yes, most people are "richards" nowadays.
 
Not to sound mean but I only hold hay for hay that is paid
for its a sellers market this year. To many times have people
in the past stuck me with extra hay in May. Hard to sell last
years then.
 
Simple, it's a business contract, seller can't
deliver at time of purchase (for whatever reason),
so you place a 25% deposit on the purchase. Make
certain that you get a signed, dated, receipt for
your deposit, stating the amount of product to be
purchased and the total cost, and a reasonable time
when you can expect to pick up the product.

Then if the seller sells out from under you, you
have LEGAL RECOURSE.
 
Cash sales are always first come, first served, especially in a seller's market. If you didn't leave a deposit (10% minimum to hold it a few days, 25% to 100% is better if you definetly want it) and you still waited more than three days to call back, then the seller was right to assume either you were not interested or you didn't have the money for the payment.

I've been in the seller's shoes and in your shoes. Yes, when I missed buying something I was mad too, but not with the seller.

or say your coming back to get it, but it may be gone. you
have to draw the line somewhere, it's really no different than
selling anything else, someone looked at a trailer I have for
sale, said he'd get back to me, if someone comes 1 minute
after he leaves and says I'll take it, than it's sold!!
 
I have sold a lot of stuff on craigslist, it is amazing how many people call with interest and plan to come, or even come and say yes I'll be back for it and NEVER come back, call, or ever hear from them again, so I've come to say first one to hand me cash gets it. Even then I had one guy buy a trailer to be picked up later and gave me the $1000 and never came back or called for 6 months! Get a written statement of money paid and a plan for pickup.
 
You're located in Saskatchewan or Alberta right? You must live in a very, very rural area. I've got 2 towns within 12 miles. I wouldn't consider anybody farther then about 2 miles an actual neighbour.
 
1)I went there to inspect the hay and did not haggle on the price he wanted and there was a very CLEAR understanding how things would go down.
I am well known in the neighborhood that when i give my word i Will come trough on it and i expect it from the other party as well.
If he wanted a downpayment all he had to do was ask for it.
In this case he would've sold the hay on me anyway cause a contract is only as good as the guy that signs it wich means nothing( been there done that)
If somehow a deal can not be realized all it takes is a phonecall with an explanation.

2)His loader/plowtractor had blown the powershift tranny and needed to get fixed first.I wasn't about to trundle down and plow his yard out when there is about 3" deep snow around these stacks and no way of knowing what i might run into,besides,.. i have my own work to do.
I had about a month worth of hay left at that time so i was not in a NEED IT TODAY position but did not have enough to get me to pasture and he knew that.And i am not some dude that has only a goat or horse to feed.
The worst is that now i have to find other hay in a hurry and there is nothing to be had that close by.

One poster thought that i should look in the mirror when i mentioned crooked neighbors and he is deadwrong.
I could post some of these stories to tell my side of it but it is dragging old dead cows from the pond and i rather let them be.

Was it kinda underhanded that he sold the hay out from under you? Maybe. If you didn't pay for it before you came to actually haul it off, and it's gone? Sorry! Next time bring your truck and tractor and load right then...
At least you still have your $$.
 
Just wait till you get a call from him wanting payment for the 150 bales that were there when he left for a few days.
