purple paint law

I agree with you completely but if your property is posted or painted then the trespasser can't claim he didn't know he was trespassing and his punishment from the courts would be harsher because of "willful intent to trespass". Many states do not require posting of private property.
 
It's still a "misdemeanor". Slap on the wrist and bye-bye.

This is quoted from the link: "Trespassing to property marked as no trespassing is a Class B misdemeanor, except when a trespasser uses a motor vehicle or if the property is designated for agricultural use. Such cases constitute a Class A misdemeanor."
 
This is why the Law was probably enacted....

"One item all-purpose vehicle owners will not like is the increase in registration fees, from $5 to $31.25 for a three-year registration"

It's just a way to get more money and make the landowner 'think' they are getting protection.
 
Still need to be tougher on trespassers. How about if your caught trespassing you forfeit all guns, bows and fishing tackle you trespassed with, loose the right to hold a hunting and fishing license for 5 years and the landowner gets to retain possession of any motor vehicle or watercraft you used in the trespass until all fines and damage claims are paid. Loss of a driver's license should be mandatory until all fines and restitution are paid. Fines would be required both on the criminal and civil aspects of the trespass. Civil fine should not be less than restitution AND the annual property tax bill on the parcel trespassed upon.
 
Sounds like it's intended to save large land owners the expense of having to buy alot of 'NO Trespassing" signs to post their property. Unfortunately someone like myself who is not quite totally "color blind" (according to the miilitary I was) but am extreemly 'color deficient' in that there are more colors I have problems seeing than those I don't. Anyway, somone like me can see, and read a sign, regardless of the color, but would be oblivious to a purple colored stripe on the side of a tree. If they want to do something like that, why not at least make the stripe in a florescent yellow, orange, ett that would actually stand out against the landscape instead of blending in against the dark colored bark on a tree.... Just another example of another politician sititng behind a desk doing something they think will be great without really thinking about it...
 
Really if you hadn't made this thread I would have never known what the purple paint meant. I haven't heard anything about a purple paint law or have never seen it used. I bet there is a lot of other people that have never heard of the purple paint law either so I don't know how it is suppose to be effective.

I believe a LEO would mention something to the effect of, "ignorance of the law is NO excuse." Just because you never heard about it, doesn't mean it's not effective.
Around here, there are people every year who pay fines for trespassing when their only defense is that it's not posted and "I didn't know" it was private.
 
My point is these legislators pass these laws and then keep it a secret. How is anyone to know purple paint plastered on a tree means no tresspassing if it is not advertised.
 
Also shoot the trespasser and his wife and children and dogs and burn his house. By golly that'll teach him. TDF
 
John Same way here in Tennessee.. No posting required, if you do not own it or have written permission you are trespassing. We own a large farm that is like a finger sticking out into a federal wildlife area so see quit a bit of folks getting over on us but law waste no time taking care of them when caught. Usually fines in excess of $ 300.00 or so.
 
wish we had it here,signs are just another target around us. trouble is anyone whos going to tresspass isnt going to pay any attention to a sign. the only one ive found that helps ,is a big sign that says "traps". strange how many hunters that keeps out. even if they are not hunting with dogs...
