i was at my brothers seen he had a room blocked off and asked why i was shocked at his response... he told me one afternoon his landlord walked in his place woke him up yelling at him while he was in bed... telling him that he is going to make the enclosed porch a bedroom for his kid.... sure enough i went into the room that was blocked off and looked through the window in the door a matress on the floor pot pipe beside it. useing brothers power yet too... i want to help him but don't know which way to point him for help get a attorney?
 
If I read this right- The landlord's brother moved in with your brother.

If the two of them have a contract the landlord cannot move his brother in without changing the contract.

Better get an attorneyon this one.

i have never heard of such a thing, maybe in the 30's and 40's? where is this? some parts of the country dont recongnize lawyers. load up and leave,he can get his rent from the deadbeat.
 
Your landlord can NOT just walk into your house and demand anything. As long as you are paying the rent it is YOUR house. I'd have him arrested for trespass and THEN I'd move out.
 
The landloard does not even have the right to go in like that to inspect the place. They have to give notice and the renter must be present. The only reason that a landloard can enter otherwise is if a electric or water problem and then can only go as far as to repair the problem and go no further in the house. That was the way it was when I had a rented house.
 
No. Since he is renting, the house is his domain. The landlord has the right to come in periodically to inspect the property but has to make an appointment to do so. He sure doesn't have the right to move in. You and your brother have every right to be mad.
 
Hmm. Speaking as a landlord, I've never heard of such a thing. But I get the drift that there may be some long-standing issues between your brother and his landlord (could there be a few late rent checks involved?), and he may be doing whatever he can to "encourage" your bro to move on down the road.

Your brother doesn't need an attorney to take his landlord to small-claims court for breach of contract. What he does need, however, is evidence that he didn't breach their contract first. And the best proof of that is a history of rent paid on time.

Given that the landlord's son left his pot pipe out in view, a call to the police would get the son "evicted". Of course your bro should first hide his own stash.
 
Implied habitability, your allergic to marijuana right, no longer habitable, and the lease is now void ? Don't quote me, I'd just move to be honest.
 
As a landlord our lease contract states how we can and cannot enter the property. It has to be during reasonable hours with reasonable notice unless it is a case of emergency or distress. Tell him to read over his lease and if the owner is in breach of the contract he can up and leave without much issue. Next choice would be small claims court for money lost on power, partial rent since he does not have full use of the house. It all depends on how his lease is written though. Shame on him if he does not have a written signed lease.
 
He can't just abandon the place. You know darn well this landlord would come after him with all guns blazing for "breach of contract" if there's a signed lease.

I get the idea that he is renting PART of a house. If the lease does not strictly define WHICH parts of the house are included, the landlord can pretty much take over any room(s) he wants to, whenever he wants. All he has to say is, "That wasn't part of the lease agreement."

You might win if you fight it with lawyers, but it will be a long drawn out battle to define which parts of the house were IMPLIED to be included in the lease.

How much time is left on the lease? If he has to move out a month or two early, and abandon the security deposit, to get out of a bad situation, it's worth it.

Does he have any interaction with the pothead kid? If the pothead kid has separate access to this room (sounds like he does?), and he's not bothering you, just wait out the lease. Then, find somewhere else to live.
 
If your brother is paying for the electric then he sure does have a case for small claims. I hate to say this but, you could also call Code Enforcement for an inspection. The laws really do favor the tenant over the landlord. If it were me I'd just move along. Sounds like a low rent district to me anyway.
 
best way ,call the law and have the landlords kid picked up if hes using drugs and you know it for sure.At least that gives your bro a claim and a record of trying to do right. Somebody else will and when he goes to jail,your bro goes along for the ride if he's in the same house. Been there done it myself. Only other thing is to help your bro move ASAP! true story, knew a fellow once who was about as nice a guy as you would ever meet,played in the okc ochestra,and taught music to kids on the side. Met a nice looking young gal and wound up marrying her.Only problem was she used drugs and he (claimed) he didnt know it.She got caught,and cops came to the house and picked him up right along with her.He wound up losing his job,every one of the kids parents wouldnt let him teach their kids anymore,lost his home,and just about every thing else.He spent a fortune on lawyers before his so called "wife" finaly told police he wasnt involved. I'm not sure that this would be entirely legal on the landlords part simply because your bro was renting that space(unless of course hes just renting a room). If he actually walled off this space,built seperate living quarters,it should have two seperate entrances,seperate utilities,etc. Myself,of course i'm not too understanding ,would quit paying rent on the full place at least,find the breaker that controls the electricity to that part of the house and shut it down,and everything else i could. Isnt you or your bro's place to support his landlords low life kid. After that i would not pay rent until he evicted me,just for meaness,which can take quite a while these days.Of course thats me,best way would be to simply get away from the idiot.
 
Worked for a landlord doing remodeling one time. We were redoing an upstairs apartment and needed to get into the lower unit to do some plumbing in the ceiling. He had the key and we went in and went to work. A little later the renter found us there and called the cops on us. They advised us to get out as quickly as we could and not come back as long as she was paying rent, we couldn't be there without her permission. Another job he gave me the key to another apartment that needed work. Said he arranged with the tenant for me to be there. I knocked on the door several times before entering. I opened the door and it was a clear shot into the bedroom. The lady was laying in bed still sleeping when I opened the door. I closed that sucker as fast as I could and got the heck out of there. It would not have been good if she woke up about that time.
 
Phone the building dept. A bedroom must have two exits in case of fire. The door and a window big enough to get out of.
