CAse 870 pto brake

Had the whole pto rebuilt last spring. Not sure what is all in there but was sent in because it would not shut off, so I am assuming a brake, and clutches. Respectable mechanic. Well , have not used the pto, other than to run an auger for about 15 minutes. Now it does turn whenit is supposed to be off, shut off tractor, hooked up to round baler. Some times it turns it, then all of a sudden it will, when the lever is in the disengaged position. Tractor was NOT in Reverse when PTO was ran that 15 minutes. Any ideas to check? Is this common in coler weather, or should I call and demand some warrenty work?
 
When it runs in the "off" position, is it just kinda idling along, or is the shaft turns full speed and power like it would be in the "on" position?


My Grandfathers 770 will idle along in the off position as long as I can remember(30+ years). On a NH square baler, the plunger would cycle every 4-5 seconds.
 
Turns at a pretty good clip. Same as if it was fully engaged. Thinking about it I am going to call the shop and demand it get fixed if they try to blow me off. Like I say, 15 minutes on pto, and only about 20 hours on the tractor since the rebuild.
 
Case 70 series had an issue with the hyd pto- IT CAN START BY ITSELF. After I found that out, I never worked on the chopper behind the 2470 unless the chopper gearbox was disengaged. Recommendation was to shut the tractor off, but who wants to wait thru cooldown to do that?
