how long till I can resell something

I Sold a John Deere snowmobile to a guy a few states away December 2010 for $500, he sent a check for $400 and was to pay the last $100 on pickup, he asked if I could keep it there for a month so he had time to get it, he would email a few times at first "coming to get next week" and nothing, its been 8 months and finally said will be there Thursday to get it then canceled, I have emailed him many times and wont reply, I have stored it here almost a year now and has to go I wanted it gone last December! what would you do?
 
DiyDave is right on the money, except I would email or write to the guy, telling him my intentions. Give him a last 30 day deadline to pick up, or we're doing the Dave thing.
 
I would sell it to someone else and send him his $400.00 back. The terms of the agreement was for you to wait a month and he broke the agreement.
 
In a situation like this I would talk with my family lawyer. Course he doesn't charge for answers like this.

This is a case where it is better to ask permission than beg forgiveness.

I've got 3 or 4 things setting around that i sold on the internet and were never picked up.It's probably around 1000 dollars worth of tractor stuff that was sold 5 or 6 years ago.
 
It has been almost a year.

I wouldn't be mad if I was the other guy, and got a letter from you saying how long you have stored it and if I didn't pick it up in 30 days it would be re sold. with me having to forfeit my 400.00 for storage. Fair is fair.

Only if he had a medical problem that may prevent him from picking it up would I feel the reason to maybe give a partial payment back.
 
I've got 800$ for a disc in my yard for over 6 months. It can sit there another 5 years as long as they are still talking to me.

he emailed me this month and said coming to get it thursday 2 weeks ago then emailed again and said wont be coming, I emailed him 3 times this month telling him it needs to go I have stored it long enough and it has to go by the end of the month, and no reply back,
 
No, you can't re-sell it. It's not yours if you cashed his check. I'd send him a letter stating what you want done with his machine. I sold a couple items this fall but the guy wanted to leave them a while. I said, "yes that's fine but they will be stored OUTSIDE" He came pretty quick and picked them up.
 
If it is stored inside then I would just tell the guy that your running out of room so it will be stored outside at the edge of the field under a tree. My guess is he will want to come get it ASAP to protect it.

If not send him his $400 back and then resell it.
 
If you have tried to contact him several times and can provide the evidence to someone that you have tried to contact him, Then sell it to someone else. If a man can't get it in a year than he didn't want it that bad to start with. You need something for your time for messing with the guy anyways. I say he doesn't get his money back. Just my 2 cents worth.
 
That's kinda the way I think. But I've got stuff I've sold as much as 6 years ago and never heard from again. I had a couple items guys didn't pick up I gave them away. One guy called a year or so after the fact. I told him I didn't think his item was here anymore.
 
Common sense says you've given this guy plenty of chances and plenty of fair warning. Legally I think you need to give him an official notice that he has 30 days.

Hopefully you have proof of the date that the transaction took place.

I assume your "contact" has all been through email. Do you have a phone number? CALL him. I will never understand why so many of you guys get all shy when it comes to using the phone.

If you've called and emailed, send him a bill for storage, with a monthly rate that figures out to exactly $400, and a notification that if he picks up the machine within 30 days, the fees will be waived. Also state that if the machine is not picked up, he forfeits all rights to ownership.
 
I'd send him a letter state'n that you are out of room and time. He can come and get it in a month/end of the year/what ever time you choose and if he has not come to get it you will set it out at the end of the driveway so it will be easy for him to load but some one might steal it. I am sure you have some one around there that would give you the other $100 for it.

Here at least the common practice is to serve him notice by certified first class mail that he has 30 days to pick up his item or storage charges of 100 dollars per day will apply. After 14 days the item will be sold to the highest and best bidder for storage, any excess collected above storage and the purchase price of 500 will be returned to him.
