Felonious Larceny

I just got back from the courthouse after watching the trial of the man who stole my 1996 John Deere Gator, our 3 month old 8 foot single-axle trailer, and a pressure washer. The jury found him guilty of misdemeanor larceny because they said that the crime was not a felony since the value of the stolen goods was not over $1000. My fathers testimony stated that the value of the Gator alone was $2000, and the trailer was worth at least $1000. The judge sentenced him for the maximum time - 4 months. This was his 17th conviction; the man is 26 years old.

I hope you got it all back. Sounds like he is in the "needed killin" category. 17 convictions and how many he got away with
 
Was wondering, Did you get your items back? Did the judge order restitution? Should have have been 1 year for every item taken by the jerk, plus cost value restitution.If he has that kind of record, and escapes severe time imposed for each offense,I would move from that area, get a lawyer and sue for compensation of items stolen.Other wise your getting royally shafted and might as well put up a welcome sign for thieves. JMHO. LOU.
 
This is why people are losing respect for the law. There was a guy in Dallas that killed five people over four years. Because he was driving drunk. His last time in court he got two years in jail.
 
A man in Texas, near here, had been convicted a number of times. He got caught stealing a dog. I don't remember how many felony convictions it takes to reach the habitual criminal level, which is a life sentance but, this guy only lacked 1 convection. The judge ask the dog owner how much the dog was worth. The owner's response was. "I wouldn't take $10,000 dollars for that ol dog." Judge sentanced the thief to life in prison.
 
Yeah, I got it back within 15 minutes of the theft. Two neighbor boys who help us with hay were taking a walk through our property. They witnessed the crime, then called us. Luckily, a police officer who lives 1 mile down the road and knows what my stuff looks like, passed the thieves about a minute after the call came in. Thanks for asking!

We did get the items back. As for restitution, the judge ordered $150 (like he'll ever pay) for damage to the mesh trailer gate. See, they didn't set the parking brake, then they peeled out of the barnyard. The Gator slid backwards and the hitch hit the gate, denting it.

Doesnt it just make you sick.

My wife has a friend that divorced a loser several years ago. This loser has 15 convictions 4 of which are felonies. He has had some jail time but his last arrest put him in a state prison for 6 months. He really needs to be put in for 6 years. Most of his arrests are drug charges and thefts.

What to do with the loser that ripped you off. ------
1. Try to get your stuff back, or at least get the insurance company to reimburse you.

2. Find someone to kick the schitt out of the guy, just for the satisfaction. He accidently got beat up while walking into the autoparts store, hey it was an accident ya know. He fell on the pavement 4 times face first....Oops.
 
Glad to hear that you got your stuff back, but the lack of justice does kinda go against the grain.
I heard about a habitual thief who was found in the woods with six bullet holes in him.
Coroner said it was the worst case of suicide he had ever seen!
 
The thief is a money maker for the legal system players including the police, lawyers, judges and all the associated support personnel. They really don't want the criminal to quit his criminal behavior because they would be out their jobs if he did. Look for the money trail and in this case you would find that he created many thousands of dollars in high paying legal system jobs paid for by the taxpayer.
 
Don't blame the judge he gave the maximum sentence he could,blame the Idiots on the jury.
Just like product liability suits its not the trial lawyers that have the last say its the
members of the jury.

"Texas justice", is that where you make the perpetrator move to Texas? Sounds like cruel and unusual punishment to me, especially if you make 'em move to a dry county.
 
Well, not really, Vern. I did misdemeanor "public defender" work for about a year when I first started practicing law. Believe me, nobody's gettin' rich. We made $110 per case, plus another hundred if it went to trial- wasn't much of a money maker. Have to have judges anyhow, per the Constitution, and they always have caseloads that are too large. And public defender program is always the target of budget cutbacks, because nobody likes the program, for obvious reasons.

Pretty much everybody in the system views it as a big PITA.
