I know this should be in a different forum but I know you folks better and wanted to share the news with the people who have been there for me.

Almost four years ago my wifes grandmother passed from cancer. Weeks before her passing her will was found, read, and 5 of the 7 children decided to have a new will drawn up. Thing is, the farm was willed to my father in law and his brother (the only two not in the writing of the new will). The new will split the farm between all 7 children with stipulations regarding having to sell the farm etc...less than 3 months later my father in law passed after a heart attack (one week to the day after our wedding actually) leaving my wife and her brother to continue the fight with their uncle. Three years later the judge ruled in favor of the new will, even though it was signed while gram was in the hospital, on meds, and while being tricked into signing. We appealed the decision months ago. We had a court proceeding/meeting and all the kids were there, by the end of the meeting the estate was settled and they gave us the farm!! The reason that they gave up the fight is beyond me but important part is that my future children, my nieces and nephews, cousins, and family we still talk too will be able to enjoy the farm for decades to come. My wife came home in tears of joy as she explained what happened and that the fight was over. What a wonderful feeling! Thanks for lisening folks...~Anthony

Congratulations... hope everything works out okay in thelong run with the rest of her family. As for staying married, we just had our 50th 2 weeks ago, so it is possible even in today's wierd world.

Doesn't help my Dad's estate when he died in 2012 but Indiana is dramatically raising the exemption to $5 million by 2015. I had to pay the state nearly $71,000, the attorney $14,000 and the accountant $3,500.

Around here, if a new will has been made up in the past few years, (I think it is 4 years but don't remember for sure) it will be invalid if anyone contested it. This is especially true if the now deceased was not capable of making rational decisions, like health issues or medication influences. I also personally know of one family that some of the brothers/sisters were prosecuted for forcing the new will to be written and signed. However, I have seen where some lawyers and judges are thick together and can get by with almost anything. I am like you, I would not give up without a major fight. If I did not win the case, at least the other side will be out a lot of money and their lawyer will be the only winner.
