Sure it will work. Even with the control valve in the circuit, it's doing the same thing anyway.

Only difference will be that now you won't have any pressure; just oil running around in a continous circle.

Oh, and ya can't dump it in the top of the tank. It'll just puke right back out the vent.

Problem with running it in a continuous circle is it will build heat, even with out pressure. Just the pump friction will over time keep the heat building. If you have enough line, it can cool, but you don't want that much line hanging off the tractor. If there is a way to cycle it back through the reservoir it would be better, otherwise in the heat this summer it will get hotter than you'd like.
 
Sure you can dump it in the top. Just get rid of the vent.

You have to seal off the vent when you add the 2-way christmas tree valve normally.

I would connect the live pump suction to the bottom and dump the output to the fill pipe on top, without a vent. That will eliminate concerns about heat.
 
I have my return in the fill tube WITH the vent cap on top. Hasn't run over in the few years i've had it that way. I am using the belly pump.
