1486 vs small car guess which one won?

1486 with two empty grain wagons was hit by a small car. The car won big time. Left turning tractor, small car tries to pass on left at 55+ miles per hour. Front axle of tractor torn completely out. Front of tractor hits ground still moving forward. Tractor breaks in two. Nobody hurt. Young man with bad license already on sr22 insurance never touched brakes while on cruise control. Air bags deployed and scuffed his face some and seatbelt bruised his shoulder. Very lucky and somewhat stupid young man.

Most likely, depending on the paint on the road and posted signs, if the 1486 driver did not have a left turn signal going, this accident was his fault. As a firefighter/EMT I have been at far to many farmer-commuter accidents. Glad there was no serious injuries.

I did say it depends on the paint on the road and the signs. Don't know if this tractors left turn was even at an intersection. He could have been turning into a field or something.

People tend to get stupid around farm machinery on the road. In Ohio passing anything at an intersection is illegal, even if on a road with no lines. I think alot of people believe farm machinery is an exception. I've been passed in no passing zones, at intersections and about everywhere imagineable. We are required now to have lights on all farm machinery at its widest point. I know not all states are like this. Doesn't seem to be making much difference. I still get passed with my left turn signal on. I cringe when a vehicle flys around me at 55+ on the hwy, just waiting for the day when some kid is on his bicycle just behind the top of that hill.

I had a Olds 98 knock a JD corn planter into a ditch in 1999 from an IH 886. The hitch did not come out of the tractor but the force sheared the bolts in the tongue of the tractor. She met me head on at dusk running 60 MPH, missed the rear tractor tire and hit the corner of the planter. Her car spun 180 degrees in less than ten feet, I don't why it did not flip over. Totaled the corn planter and car. The car had air bags and no one was hurt. It was her fault, in Indiana farm machinery has the right of way, except on interstates where prohibited.

sorry, I meant to say tongue of the planter. It was a JD 7000 with dry boxes. We had just loaded it before moving to another field. It knocked every bit of the fertilizer out of the planter - it must have shot straight up into the air. We had to shovel it all up off of the road,

Most older tractors do not have turn signals. It don't take rocket science to see tractor, common sense would say, slow down, then if tractor turns, no one gets hurt.

Over the years I've heard many people say that it's illegal to pass at an intersection, but I've never been able to actually find that law in any state I've lived in. Maybe some states have it and some don't.

It's sort of like the rumor that it's illegal to drive barefoot. Maybe in some places, but again I haven't been able to find it in writing.

Here's what it says in the TN driver's hand book.
3. No Passing: It is not always safe to pass. Make certain
the way is clear. Give the proper signal before changing
lanes. Tap your horn when necessary to avoid surprising
the driver ahead. Avoid cutting in too quickly if you must
return to your original lane. Remember, you may NOT
cross the center line to pass under the following
conditions:
• Do not pass when there is an oncoming car.
• Do not pass when approaching any road-way
intersection, railroad crossing, narrow bridge, viaduct
or tunnel.

I'll have to do a little more digging to find the actual law. In the mean time passing/no passing zones, solid yellow lines and common sense will need to prevail.

I had a guy drill me in the left door up in MI. when I was making a left that I had signaled well in advance. The trooper cited him for passing in a no passing zone, there were both signs and well painted lines that the guy ignored.

I know the law in North Dakota states that when you approach ANY vehicle with a SLOW MOVING VEHICLE (SMV) sign, you must SLOW to their speed, then you may pass them.

And it's illegal to pass at an intersection, got pulled over for that myself in ND.

Randy: The guy in the car is very lucky, the front axle on the 1486 must have been ready to fall off. I had the same thing happen driving my 560. The car wasn't going as fast, probably 30 MPH, however he hooked 560 front wheel, rolling of the wheel took the car up, he slid along top of tractor wheel until his rear wheel went over the tractor tire. At that point the car rolled. The 560 suffered no damage, car quite a bit.

He and his wife not injured, well maybe he, she weighed about 250#, and he maintained if she had her seat belt on and stayed on her own side of car, it would not have rolled. I didn't get involved in that one. His language was quite rough, he cursed me and he cursed her. Two days later he appologized to me in farm store. He was a fellow farmer, and I knew them quite well. This had happened after a sharp left curve in the road. The young lad a non farm boy following him had seen my signal lights soon as he came in sight round the curve, well before the old guy attempted to pass.

I did not see the ticket he got, however my insurance fought this on the premis he was passing in an intersection, crossing a solid double line and passing a vehicle displaying a proper left hand turning signal.

ND Vehical code 39-10-14 says no passing within 100 ft of an intersection. What an intersection is not clear. (a field approach ?)

However, 39-10-35, tells how left hand turns will be done.

39-10-38, Turning movements and required signals, gives more insight. Farm equipment is not exempt.

39-10-45, Emerging from a driveway, private road or building, restricts us a bit more.

The only thing I remember about aboud SMV signs is they were required on certian vehicals. Don"t remember anything in the vehical code that says you have to reduce to it's speed before passing. Perhaps it was in a driving guide, I don't know.

I would hate to think I forgot everything from my 4 months as a Sherrif Deputy.

Pa Vehicle code and new driver's learning manual says illegal (3-points on the point system and $100 ish fine) to passing within x feet of intersection, hilltop, railroad crossing, and a fourth one that I forget.

AAA did a poll once asking drivers what the SMV sign meant. The scary part is that less then 10% of drivers knew what it meant. 90% of drivers thought it was to show the end of a driveway(an illegal use of the sign in Michigan). I've had my own fair share of close calls one that stands out is when I was driving my 886 with a 10ft. snow blade on the front home from my in-laws and even though I had my flashers on and my wife who was following me in her car had hers on the idiot still passed me 50ft. from an intersection and on a blind curve. He barely missed an oncoming county plow truck with his little grand prix(little compared to us others). With snow on the road I know I couldn't have stopped in time and probably would have killed him. It made it hard to sleep that night even though I wouldn't have been at fault I still would have taken another person's life.
